谢谢大家的关注,第一次在未名发帖,帮好朋友发帖问一下,看看还有没有得救？
情况: 05/10/2013毕业 04/23/2013填写了OPT申请表 06/05/2013寄出OPT申请去
USCIS 06/07/2013收到USCIS的receipt 10/11/2013网上track显示denial 10/18
/2013正式收到decision letter
被拒原因: USCIS has reviewed the evidence of record and found that the
Designated School Official (DSO) entered the request for OPT employment into
the applicant's SEVIS record on April 23, 2013. However, the applicant did
not submit this application until June 05, 2013, more than 30 days after the
SEVIS request was made.
想问一下像朋友这种情况现在有没有必要找律师并且file a motion? 大概的成功率?
类似的case开销大概是多少?
如果不再提交I-290B的话, 朋友还可以在美国合法居留的天数是?

你们学校ISO没跟你说一定要30天之内提交么，我当时的ISO千叮咛万嘱咐生怕错过dead
line。
这是明确规定的，不知道后续要怎么处理了。律师估计了解OPT的不多，最好自己先在
USCIS网站上研究下。

这个是什么情况？
是不是说开新OPT的I20时间和申请OPT时间不要超过30天？
这个。。我的情况是6月份开了新的OPT I20,但是后来我没来得及递交申请就过期了。
于是我8月头又重新找ISS新开了一份OPT I20，8月20号的时候寄过去申请了。。。
不知道这样可以不可以啊，至今没收到任何通知

你漏了一个重要的时间点：学校更改I20的时间。
看样子是学校当天就给你改了I20，那这样的话，就不用花钱找律师了，没啥用了。
难道你们学校没有告诉你30天之内要寄出去吗？为啥不在毕业前3个月就寄出去呢？

OPT application (I-765) should be filed within 30 days from I-20 (with OPT
annotation) issued date.
And now it already passed 60 days grace period (after graduation or last day
of class), you cannot do COS without leaving US. Or you can find another
school program issuing I-20, and see if you need to reinstate F1. (if within
5 months after your graduation or last day of class)

是邮寄来的么？

我是学校给我寄的
上周五改的I20，这周一给学校offer letter，然后他们说周三寄出去……
看了好怕怕

加急也是学校弄的
我现在有个问题
我们学校主页上说的
check写给USCIS
然后我就写了USCIS
国际办公室的人还帮我double check了一下我的支票，说没问题
可我刚才看，是写给U.S Department of Homeland Security
这个行不行啊
我现在紧张……

我们学校写的是USCIS
然后我就写了这个
我看别的学校是homeland security
不过我们已经毕业的，都是写USCIS，也没事
所以应该OK

抓进去ISSO问问吧，错过了这个deadline基本无解了，不晓得你为什么拖这么久。

从来没有人提醒过你30天的那个规定吗？
你自己等了那么久没消息也该早点去问问。现在这个情况，估计找律师是唯一可以试
试的了，不过个人感觉用处也不大。
你5月就毕业了，早就过了F1的grace period，应该是要尽快离境了。。。这个问题你
应该去学校DSO咨询或者也可以去问律师。
也别太急了，都到这一步了，说不定律师能在哪里找到漏洞。
另外，重启案子，如果肯定不是移民局的错误的话，很难，又慢又难

USCIS是国土安全局下面的一个机构，应该问题不大，你什么时候寄出的check？现在被
USCIS兑掉了吗？

我问了我们国际办公室的
他们说没问题
之前有毕业的，也是像我那么写的
应该问题不大
国际办公室说上周三给我寄的，加急什么也都是他们把我offer letter拿去弄的
现在就等着吧，赶紧办下来吧！
