我今年H1b抽中并approve了，但现在公司很不稳定，很可能快要裁人。我最近在积极面
试，有一家新公司给我offer了，offer letter上的start date是9月14号。但因为我今
年H1b要到10月1号才生效，所以我有下面一些问题请教各位。
1. 10月1号H1b生效之前转H1b，今年还是可行的吗？有成功的例子吗？风险大吗？
2. 如果一定要到10月1号之后再做h1b transfer, 那么大概的timeline是怎样？最早的
入职时间大概是什么时候？
3. 我想跟新公司negotiate, 把start date推迟三到四周，我觉得这样对H1b transfer比
较稳妥。请问入职推迟三四周，一般公司可以接受吗？会不会有cancel offer的风险？
请各位帮忙给些意见，看看我这个情况应该怎么处理比较好。非常感谢！

1-2个月的gap没事的，你现在公司不会办PP撤销你H1的，正常的撤销至少3-4个月。即
使现在被裁，只要你有最近的pay stub，让你下家写10月1号生效，不需要出境就能激
活。

恩，我现在旧公司这边应该是不会在10月之前revoke的，所以现在主要的麻烦在于我要
不要等到10月之后再transfer，如果等到10月要怎么跟公司negotiate推迟入职时间。
您的意思是，我还是到10月1号之后做transfer，然后争取推迟到新公司的入职时间？
因为新公司让我9月14号入职，这样会有cancel offer的风险吗？要怎么跟公司商量比
较好呢？

和新司的hr商量好，可以的话就十一后入职。
不行的话，那应该是新司的hr和attorney认为十一前transfer没问题，那就让他们办好
了，万一deny也没什么影响，十一后再申请一次就是了。

新公司hr说start date根据h1b transfer的进程可以有一些flexibility, 不过没说具
体能容许多久的flexibility. hr也不是太懂h1b，好像是默认我h1b可以正常转的，并
不知道我的情况其实更复杂。
我的offer letter上的条件是approval of h1b transfer, 我现在不知道他们是不是要
等我h1b transfer approve了才能上班，等过几天他们安排我和律师聊了再说吧。
这几天都有点担心啊，希望能一切顺利！

刚转完，用pp 1周时间就approve了，很快。

请问你是今年刚申的H1b吗？是在10月1号H1b生效前转的？

确实是一个很困惑的问题，个人理解，其实取决于原公司是否revoke吧
看看下面这个链接，有点帮助

“If the H-1B is revoked before the beneficiary can be considered in H-1B
status – i.e. before October 1 of the given year, or if they consular
process, prior to the beneficiary using the petition to apply for a visa/
admission, then they would not be considered counted under the cap.
If Company A’s approved petition is withdrawn before the new petition with
Company B is approved, then the individual would no longer be considered “
counted” under the cap.
The new petition would be denied for filing outside of the H-1B cap window.

还有这篇文章，似乎说2014年之前是可以这么做的，之后似乎有问题了

我现在看到有10月生效前transfer通过的，也有没通过的。律师也是有些说可以在10月
前transfer，有些说不可以。
所以我觉得也只能跟新公司的律师讨论，看他们的选择了。

H-1B批准之后就可以transfer，不需等到生效。

多谢版主提示！
目前还在background check,公司还没安排律师准备transfer事项。。到时候和律师聊
的时候，再看他们怎么说吧。。

Update:
今天跟律师联系了，我把我的情况跟律师详细说了。律师的意思是10月前就transfer,
说移民局怎么处理会有variation, 建议我在拿到approval前不要notice现雇主。律师
还说有很大可能会被rfe, 这样的话拿到approval就要再delay几周。
希望能一切顺利，后面有进展我也会跟大家update。
