theoretically, yes. Practically, very hard. The reason is that you will be interviewed in consulate when visa is available. By that time, if you cannot provide a job offer letter evidence to prove that you will work in the same field as when you applied NIW, you will be denied. So can you guarantee that you will have a job offer (even if it is a postdoc position) by the time when you are interviewed after you go back to China? I don't think that is easy.

Well, that is true. But what I am interested in is EB number allocated through CP. There is quite a good portion or percentage of EB visa numbers that are allocated to CP as well. I don't know the detail percentage, maybe around 30-40% of total EB category are still approved through CP. I am wondering, are those CP approved numbers the cases described as above, namely, people with 140 approved, but go back to china to wait for visa available. And how many such cases are approved each fiscal year
