老婆所在的部门被砍掉了,全部走了。她是副申请人,485已经交了。EAD/AP还没有批
。我有两个问题想请交一下。(先谢谢大家了)
1.如果她不转成H-4,是不是就自动进入AOS,能合法待在美国?以后也能用EAD和AP?
2.因为的她的预产期比雇佣截至日早,所以她的公司允许她用6个礼拜的unpaid FMLA(
工资是保险公司的short-term disbility付)。雇佣截至日是她的FMLA结束的那天。我
们本来想这样进行的,把转H-4的申请在FMLA开始的时候交上去,H4生效日就是填6个星
期之后。可是昨天看了网上一个律师的话(下面的英文),大致意思是只有当FMLA结束
后继续为雇主工作,移民局才能承认FMLA期间是合法的。这个是不是说我老婆这次连
FMLA都不能用了?

dependent upon whether there is an expectation of continuing employment at
the conclusion of the leave of absence. If there is -- even if the leave is
extended -- the employee is in valid status. If there is no expectation of
continuing employment, the employee is not in valid status during the leave
period."
