Can't really type Chinese on this computer, but want to report the news
about my case as a small contribution here. Thanks for yoyo's tips during
the process:
140 filed with PP
Center: NSC
RD: 12/17/2013
ND: 12/18/2013
2nd PP sent: 01/13/2014
140 PP received: 01/16/2014
140 Approved: 01/21/2014
Offical Approval e-notice: 01/23/2014
Did not do concurrent filing of 485, so nothing to report on 485 yet.
PS: since so many people asked about my 485, wanted to put it here to make
it clear: I filed my 485 before 140 was approved. It was filed at the end of
last week, so I haven't heard any news about it. And the company lawyer did
not tell me how she filed it, with 140 receipt notice or not.

Yes, filed with PP, got rejected the 1st time, filed the 2nd one almost a
month later, accepted.
I don't have any update on 485,but have submitted it last week before my 140
was approved. And my 140 approval has my EB2 PD, so I think it will be a
relink

Oh, no, my EB2 is not current, but the date is current for EB3. so it's not
relink?

不是，你是按照3类提交的485.
交2类的140只是为了保留PD。
将来2类C了，可以选择relink到2类，也可以不动。

请问pp是什么意思。也就是说你现在的EB3的140批了，你EB2 pd是6/2010可以给你的
EB3 I-140用，所以你就是current了，你准备要递485了吗？
请问还是以前一样的position么？需要重新办perm么？

你假装啥事没有的话，你的485对应的是3类的140，USCIS也假装啥事都没有让你在2类
和3类排着，但是要按照3类的时间表给你发卡，
除非你告诉USCIS，我想换队到2类，它才看2类的时间表。

PP means premium processing. Yes, I can use my EB2 PD for EB3.
I have submitted my 485. I am still in the same function area. My case was
approved without new perm.

I've already mentioned, I submitted 485 without 140 approval notice. I don't
know if the company lawyer used the receipt notice or not. But don't think
it would matter much, since it seems you can do concurrently filing to begin
with.

By the way, your success is really exciting. My company lawyer said that if
my 140 is approved under regular processing for eb-3, I cannot go back to
eb-2. I wonder if I can just withdraw my eb-2 if still under regular
processing once eb3 retrogresses. My pd date is middle May, 2010.

Meaning you are stuck with EB-3 IF your 140 is approved (under PP or not; if

Check your old I-797 to see which center processed your I-140 last time,
most likely it will be the same when you re-file.

不同的律师有不同的说法，我们公司律师没说EB3批准了，EB2就作废。再说了，
485pending总比EB2 连门都进不去强。看看现在EB3批准的PD日期，就算retrogress，
也不会比EB2慢

I agree with you and I am gonna try it. How long will
485 usually take to approve? How do you ask your lawyer to file 485? I am
a little concerned that they will not file 485 until the EB-3 140 will be
approved.
And my company lawyer meant if you haven't got your gc but your EB3-140 was
approved, you can only stick with EB3 but not EB2, so if EB3 retrogresses,
you will be stuck. I am not sure why she said so either. I think the risk
is more than return. If I failed PP and EB2 gets faster than EB3, I will
ask her whether I can withdraw my 140 application since my PD date was in
Mid May, 2010.

It sounds to me that your lawyer is reciting your company policy, but not
what really happens when you re-file for EB3. Sounds to me that your company
is only willing to file 485 once, that's why the lawyer is saying you are
going to be stuck in EB3. I can't say 100% sure that nothing is going to
happen to your EB2, because no one knows, but the general consensus right
now is both your EB2 and EB3 140 will be valid. You are filing for a new I-
140, not an amendment, so your old I-140 will still stay there, no one is
going to take that away unless your company revokes it.
Use premium processing for I140, it only takes about a month, you will be
fine in this case even if they don't file 485 until your 140 is approved.But
if your EB2 PD is not current under EB3, then I would suggest to wait and
not jump into this uncertainty.

EAD是工卡，可以工作，但是485批下来之前需要每年都renew，AP是什么呢？是不是一
个跟再次入境有关的东西？
再问一个问题
为什么那么多人把140和485一起在降级过程中递交了呢？有什么好处呢？
若是等140批下来再递交485，有什么坏处呢？

一起交就是为了不会因为排期倒退不能递485
140现在能不能加急还没确定，几个月140下来了你的485也上不去了，降级的意义就没
有了。
不用恶补也不用精华区，有个朋友叫google，几秒钟之内什么都能告诉你。
