at will 并不适合一切情形,很多州的法律有exception,各州不同。比如
discrimination,在加州肯定不能at will。只要能和discrimination沾上点边。at
will 就不适应了。公司在offer里只写at will,不写exception。尼玛!
如锅你的case和discrimination沾上关系。那公司用at will来赶走人就是违法了。你
就可以告他。
好了,现在公司搞个pip,装模作样搞一大推,首先给你个印象是你自己表现不好,让
你自责,觉得对不起公司,再给你点钱,骗你签个字。放弃告公司的权利。意思就是我
违法了,但你放弃告我。
如果真是performance问题,比如我一个小学水平和一堆博士水平在一起混,不用你pip
,我自己都不好意思混,早自动辞职了。
就像一个人想对另外一个人干违法的事,便请个客吃个饭。酒过三巡,忽悠那个人签了
个字。
违法就是违法。
至于能不能和discrimination沾上关系,那就case by case了。如果你有证据在手,想
完全证明和discrimination没关系也没那么容易。比如我现在搜集10个全是pip老中。
你公司说不是歧视,你得拿出10个pip非老中的例子。
hr一般会说,你签个字,不代表什么。如果你不签,他就又说,你签不签都一样,我们
是at will的。既然at will,你让老子签个毛啊。然后你还不签,他就会威胁你说签不
签都一样,都自动生效。既然都一样,还让我签,你有病吗?然后你说,律师不让我签
。然后hr脸色大变,说明天再和你谈。其实明天他和你经理谈:“这家伙是个刺头,不
太好搞,要不然咱先等一下?“
