I applied O-1 and the company lawyer is very familiar with the application
process. I just provide a list, requested by the lawyer:
Documents Required From Intended Employee:
1. Completed Background Information Sheet
2. Photocopy of passport (every page)
3. All academic diplomas
4. Updated resume
5. Copies of awards (if any) , together with a description of the
significance of those awards)
6. List of professional organizations in which the applicant is currently
a member, together with a description for the membership’s requirements (
if any)
7. Complete list, as well as actual copies of publications and
presentations (if any)
8. List of citations to publications (if any)
9. Copies of several actual articles citing work (if any)
10. List of positions with well-known organizations in the field
11. Any other indicia of stature in the field of endeavor
12. Detailed description of research (if applicable) and field of
expertise (in layman’s terms)
13. Copies of previous Forms DS-2019 or IAP-66 and all visa stamps (if
any)
14. Reference letters (to be expanded upon)
15. Copy of offer letter, Title, job description and remuneration
16. Written advisory opinion from the appropriate consulting entity,
unless it can be established that an appropriate peer group, including a
labor organization, does not exist. The definition of “peer group” is:
(i) Peer group means a group or organization which is comprised of
practitioners of the alien’s occupation. If there is a collective
bargaining representative of an employer’s employees in the occupational
classification for which the alien is being sought, such a representative
may be considered the appropriate peer group for purposes of consultation.
Documents Required From Employer:
1. Date of Incorporation and Certificate of Incorporation, or Articles of
Formation
2. Federal Tax Identification Number
3. Current number of employees
4. Most recent Annual Report, Financial Statements, Federal Income Tax
Return or, if not available, total revenues and net income
5. Brochure or website print out describing the employer
6. Name, contact information and title of the person who will be signing
petition documents on the employer’s behalf
