我们公司总部要关掉湾区的分部。所有人在二月底被lay off。
在和HR通话的时候，我告诉她一月份用了四天的sick day leave。
我们一年才有四天。所以她立刻就告诉我“ I owe company money, i need to pay
back the sick days."
the reason is I have not accrued yet.
请问这种说法对吗？我们的sick day是use it or lose it at the end of the year.
所以为什么我还要给公司钱呢？合法合理吗？

合法合理.
It's up to the company to have all 4 days available at the beginning of the
year, OR accrued thru-out the year which is 4/12 days available by end of
Feb, OR whatever rules the company set, for example 1 day after 3 month of
service.

所以我现在就是要弄清楚，这四天是在年初就给了我们，还是我要自己accrue对吧。

that.

刚查了我的pay stub，根本没有这一项。
那现在怎么办呢？

How do your company keep track of sick leave/vacation usage? Are the sick
leave/vacation balance available on-line?
Or everything is old-fashioned in HR/Payrolls computer or file cabinet? If
that's the case, I'm sorry you might have to follow HRs instruction. Her
wording implied your company is using accruement.

she is also not clear. she said she will confirm with accounting.
so now i need to find out how my company keep track of our sick and vacation
days.
i am more worried she will lie to me since there is no solid document on
this scenario.

对啊，更恶心的是，severance里面写了我们要工作到最后一天，这是拿到severance的
条件。
我已经很忍了。结果HR又来一句，哦，你欠我们钱。我简直要爆发了。

很多公司都有这个系统，但是你要不输入，谁也不知道你用了vacation还是sick leave
. 有些公司sick leave就10天

Your only chance is to challenge the 4-day sick leave is available at the
beginning, you have the right to use at any time. See if employee's
handbook specifies that. Ask for the documentation that sick leave is
accrued.

All severance packages states that, but you control how you want to "work",

yes, I will need her to provide written document on this policy. I just
checked my employee handbook, it says 4 days but didn't say it is accrue
based or anything else.

You can email her, but make sure tone down a bit. Say something like, my
understanding is the 4-day is available at the beginning, I can use it at
any time. Is there a clear documentation that the sick days are accrued
over the time?
Something along that line.

你欠公司钱。但是公司不可以从你工资上扣。

we have unlimited. of course I don't use it often.
less than 7 days,just need manager's approval

没有宣布当天就让走人已经不错了，上班又不打卡，自己看着办吧，何必着急上火。

看样子你们公司policy比较松，你一开始都不用提这事。其实钱又不是HR的，你要心平
气和，谁会跟要走的人过不去。

I told my manager who is in another state. he is also not clear how sick
days working. anyhow, he is going to talk to hr to find out. maybe I should
just wait.
