因为AP EAD 卡还有4个月要过期，绿卡SR说还在background check。RD 03/2017。所以
打算申请新的AP和EAD了。有没有确定的官方说明现在申请必须要在美国等嘛？因为我
爱人打算回国呆段时间。谢谢！

建议最好拿到再回国。特别是在国内要待很久的情况。

我以为只是个例，后来又改回来了。如果实在被拒，我现在依然是H1B的签证，我爱人
还能在国内申请H4的签证回来嘛？

核心是要保证485的存在。如果AP过期之前回来都没问题，不管什么身份回来。
并不能在国内等待AP的。新的AP在没有批准之前离境，很多时候是被解释为否决的。

那如果递交了新ap申请，用没过期的老ap回来，然后ap申请被拒，如果再递交ap申请，
还是会被拒，永远被拒吗？

那感觉其实也没啥关系啊，反正EAD不受影响，AP悲剧了，回来再申一次就好了，又不
要钱。。。理解有误吗？

BTW， I131 instruction明确写着AP申请过程中离开美国算作放弃AP申请，而且是16年
底就发布的，不知道为什么很多人还抱有希望觉得这样可以过关。被拒是正常，过了才
是侥幸吧

底就发布的，不知道为什么很多人还抱有希望觉得这样可以过关。被拒是正常，过了才
是侥幸吧

因为USCIS之前明确跟律师组织说过这种情况下AP不会拒。看https://www.uscis.gov/
sites/default/files/files/nativedocuments/AILA_2Apr08.pdf 第16页
USCIS: (a) If a foreign national (i) already possesses a valid, unexpired
advance parole, (ii) applies for a new advance parole while he/she is
present in the U.S., and (iii) then departs the U.S., the foreign national
must return to the U.S. during the validity period of the current advance
parole already in his or her possession. If the foreign national returns
timely, abandonment of the pending advance parole application would not
occur.
...
(b) Yes, we confirm that that abandonment of a pending advance parole
application does not occur if the foreign national is otherwise authorized
to depart and return because the foreign national has an 1-485 pending and
is readmitted as an H-1, H-4, L-1, L-2, K-3, K-4, V-1, V-2, or V-3.
而且NSC已经承认这样做是错的，不再拒了：
