不好意思问个弱智问题，国内不满18岁的杀人犯被判死刑吗？我一直以为少年犯是没有死
刑的。
这是从今天的Economist杂志上看到的，有些不解。谁可以来说明一下，谢谢。

I am originally from Taiwan. Americanized, after 20 years. So I am fiercely
against death penalty, including those carried out in Taiwan. I dare not visit
China, for I was told that death penalty can be handed down, in China, to
crimes of pronography. The shame about Chen (Shui-bian) administration in
Taiwan is before Democratic Progressive Party (DPP) gained power in the 2000
presidential election, it vowed to abolish death penalty in Taiwan; nothing
has been done since. I have complained to Am

in China mainland, the death penalty needs the approve of supreme court
same as American
and children age less than 18 are not eligible for death penalty

Yesterday I cited Amnesty International which stated that China does
occasionally executed convicts for crimes perpetrated before age 18.
Justice Kennedy wrote for the US Supreme Court in Roper v. Simmons (decided
Mar. 1, 2005) 543 U.S. _. At page 23 of the slip opinion, he stated,
"{O]nly seven countries other than the United States have executed juvenile
offenders since 1990: Iran, Pakistan, Saudi Arabia, Yemen, Nigeria,the

Thanks for your inputs. 我最先疑惑的是，在我记忆中中国对少年犯是不用死刑的，我
的怀疑1，可能我记忆出错，2，可能报纸信息出错。所以我在这里咨询一下。不过现在这
个问题还是和原先一样。还是没有打消这两个疑惑。Anyway, thank you for the help.

印象中是这个案子，就是农村有一家儿子犯了死罪，要判死刑，
然后那家父母说其实他们儿子当时未满18岁，因为为了参军之类
事情，把年龄改大了（这在农村很正常）。最后法院还是按照
户口本的年龄判的，估计说的是这个案子

As I indicated, my knowledge about laws and reality in China is limited. To
answer the question posed by Kokororo, I cited two sources: Amnesty
International and an opinion of US Supreme Court (

The two sources have elements of agreement and seeming disparity. Tin stated

I have done more research.
Now that the Supreme Court decision, Roper v. Simmons (where respondent
Simmons is the condemned, and petitioner Roper is the warden), cited pages
49-50 of respondent brief. I went to LEXIS/NEXIS (a paid site) to make a copy
of key portion of the brief, which was submitted to the court on July 19,
2004.
Explanations:
For acronyms CRC and CCPR, I incorporated two sentences preceeding pages 49
and 50. The "n104" means footnote No. 104. The [*49] denoted page 49 in
LEXIS/

The following is reproduced, through the LEXIs/NEXIS paid site, from pages 15
to 18 of an amicus Curiae (Latin words meaning "friend of the court")
submitted to US Supreme Court in the case Roper v. Simmons. This amicus brief
was submitted on Jul. 19, 2004 also, by The Dalai Lama, Amnesty International
as well as others, urging the court to abolish death penalty on juveniles.
China was mentioned in the second paragraph, n 62 and the text right before

这个问题最根本的证据是“中华人民共和国刑法”第49条
rake已经给出了原文，俺给出了原文连接
其他source都是不确实的
唯一可以argue那个1990年以后的是现在的刑法是1997年修订版
不知道旧刑法是怎么说的，在1990~1997年之间怎么样
现在肯定不会判未成年人死刑
Economist的说法可以说是以讹传讹，而且相当有误导性，因为
从其口气来看暗示美国改变了但是其他7个国家还在继续这种做法

中国法律的事情不找中国法律看，确实可笑。

97刑法相对于79刑法死刑应用上修改了不少，
“取消了79刑法关于对已满 16岁不满 18岁的未成年人可以判处死刑同时宣告缓期执行的
规定。79刑法第44条规定，“犯罪时不满 18岁的人和审判时怀孕的妇女不适用死刑。已
满16岁不满18岁的,如果所犯罪行特别严重，可以判处死刑缓期两年执行”。这一规定从
逻辑上看，前后是矛盾的。因为，“犯罪时不满18岁的人不适用死刑”，意指未成年人犯
任何罪时，只要不满18岁，都不得判处死刑，当然也包括不得判处死刑缓期二年执行。刑
法修订时，删除了79刑法关于不满18岁的人可以判处死刑缓期二年执行的规定，从而消除
了刑法条文中明显的逻辑矛盾，更重要的是限制了死刑适用的范围和死缓适用的条件。”
