Yes, It is a misdemeanor in Massachusetts, where I live.
Mass. General Laws chapter 277, section 39 defines fornicaion as "Sexual
intercourse between an unmarried male and an unmarried female." The punishment
is: "Whoever commits fornication shall be punished by imprisonment for not
more than three months or by a fine of not more than thirty dollars." Mass.
General Laws Chapter 272, section 18.
Incidentally, adultery in Mass. state law is defined as "sexual intercourse

I'll check the treaties. It's really hard to believe that this is still a
