前几天,我发了贴子,就是LENDER APPRAISAL 价格比房子的OFFER价格少$18K。 因
为这样,我就要补差价做DOWN PAYMENT。 我们就跟BUILDER 讲价,BUILDER不同意降价
,坚持让我们换他们的LENDER。后来,没办法,我就跟前面的LENDER说了,付了已经做
APPRAISAL 和CREDIT REPORT 的钱,还送了个GIFT CARD 表示感谢。LENDER 人很好,
表示理解。
我就担心BUILDER的LENDER 不HONEST,出尔反常尔。没想到真是这样。上星期三,他给
了GOOD FAITH ESTIMATE, 下来DOWN PAYMENT 是 $126K。今天,他突然来信说,
有问题,我必须付 $143K DOWN PAYMENT。 一下字多了$17K。 让我到哪里找这
么多钱啊??
我怎么半啊?现在这个LENDER是和BUILDER一火的,我会不会丢掉我的EARNEST MONEY啊
???
这个LENDER 太可恨了, 如果一开始就说我必须副$143K的DOWN PAY, BUILDER 就
没有理由让我换LENDER 啊??
怎么样才算贷款贷不来呢?我现在真不想买这个房子了,一下子超过$20K的预算,
而且BUILDER的LENDER 太可恨了. 我还有什么办法拿回我的EARNEST MONEY?
我都急死了。谢谢大家赐教。

Appraisal低了$18K的意思就是你自己要补钱进去,但是我不明白为什么要多付$17K。
看看你的offer吧,Loan Contingency有没有过期,如果没有的话,就Back out好了。

No, my loan contingency date is 10/21/2010.
Because last Wednesday the lender gave me GFE (good faith estimate) and he
said the down pay was $126K. However, today he sent me an email and said I
need to pay $143K (143-126 = $17K).
How can I back out? This lender is on the side of the builder (the seller)
....

ft. You are not charged with murder. Just hire a real estate lawyer
who will handle your house purchase and loan. He/she will tell you whether
you can back out of the deal or not. The most you do is to pay a few hundred
more than usual.

Where are you?
You mean buyer agent? I already have one, but she does not know the law. It
is hard to fight with the builder?
For the real estate lawyer, Yes, they did charge $250-$300 per hour.[The cheapest one I found was $250] A few months. ago, I signed the offer contract for a house, but the seller changed the mind. Then, I contacted laywer and only asked some questions.Later he said we talked 2 hours totally and I paied him $500.

有agent让agent 告诉builder back out, use loan contingency, and get your mone
y back. if your agent doesn't do it, report him/her to realtor association o
r his boss etc.

对呀,就和Builder/Lender说你没有那么多的Downpayment,然后就不要这个房子就好
了。

请律师似乎没必要。一来是 costs,二来时间上也来不及。当前要决定的是退与不退。
Loan contingency 如果是在10/21到期,那你完全有理由退出。Loan contingency 的
用意就是在 Loan办不下来的时候,只要有合理的解释,包括 appraisal value 达不到
,你就有权退出来。Earnest money deposit 应全数退还。
请你的 loan agent 出一封信给 Builder 就好, real estate agent 可以帮忙 follow
up.

The key is that my previous lender gave me a denial letter, but we didn't back out.Because the builder asked us to use their lender (Wells Fargo). Now, that guy in Wells Fargo didn't give me a denial letter. He cheated me.
I required wells fargo lender has to match/beat my previous lender, and then I can work with him. Last Wednesday, he gave me good data. Down pay was $126K. Yesterday he sent email and told me that down pay has to be $143K.
The lender in Wells Fargo is cheating!!! Can I still back out?

the written correspondence (email, etc) can prove Builder/Wells Fargo knew
the situation and the required appraised value that must equal to sale price
in order for you to qualify a loan w/ the down payment you're putting. you
showed Wells the denial letter from previous lender? did you work w/ Wells
retail bank? you should have every right to back out in this situation w/o
losing your EMD.
normally, Builder will work w/ buyer as long as you have legit reason.
how's the sales of the prop you're buying? if strong, Builder has no worry
of finding a substitute buyer and thus no need to keep you on the "hook".
ask your agent to communicate w/ builder--no complicated laws involved here

1st, ask the loan officer to explain that $17k difference to you and make
sure that is for the down payment. 2nd, ask the loan officer to show you the
new appraisal report which is backing your loan amount. If the appraised
value is less than your contracted number and you do have a financing
contingency, you can either force the seller to lower the price or walk with
all your EM. Get a lawyer if you need one. By the way, where's your agent?
you didn't sound like being well advised.

不会你的Buyer Agent是个菜鸟吧?这么简单的事还急成这样?Sign一个"Cancel of
Contract"
and submit before Oct 21(Loan contingency & Appraisal contingency usually
the same date), seller is obligated to return your EMD. That's it!

所以你活该啊。
首先你的房子不值这个钱,你拼死要买,还要自己多出$18k,
其次你用seller's lender,这个就是说我答应任你蹂躏。

银行appraisal 说你这个房子值1000,但是lz要出1500买。银行说那你得多放点钱我风
险低点。

i dont think a property attorney will charge you hourly, usually this kind
of attorney will charge you couple hundreds only ($200 - 500) for the deal
read your mortgage commitment carefully, if they marked loan amount $XX, i
dont think they can lower that amount if the commitment had been signed by
both side. unless its marked by LTV.
but hire an attorney, i dont think its a problem if u want ur earnesy money
back.

你不同意这个lender的offer就行了,啥都不说,啥都不给,啥事都没有。
相反,你也可以拿着那个appraisal的东西要builder降价, 他不降价你不合作贷款根
本就没有办法做。 到最后拿loan contingency要你的earnest money.
其实,这是你讨价还价的好机会。

appraisal估价低了,能贷的款就少了,purchase price没变的话,down pay就多了。

问题一,builder的lender沿用了你之前的appraisal价格么?我的理解是,如果
builder坚持要用他们的lender的话,应该确保appraisal价格与房价没有那么大差距才reasonable呀。要不干嘛用他们的lender。
问题二,我不认为GFE上可以show出需要多少down pay这个问题,GFE是贷款的收费表,中间不涉及down pay的问题,贷款申请表里倒是会有down pay显示,再有就是HUD上会有显示,但是看LZ的进度应该还没到能看到HUD的阶段吧。
如果,真不想买这个房子了,提供不出足够的assets证明,lender应该decline这个贷款申请,银行不批贷款,自然不用买房了。

你没经历过这个事情,没概念而已。
我举个例子,比如我家买一个房子,卖家出价20万,我出2万首付,找银行贷18万。但
是银行估价说这房子只值17万,它不可能同意贷18万给我。
卖主不肯降价,我又特喜欢这房子,于是我就要出3万首付,找银行贷17万。
我家买房子的时候,realtor就跟我们讲过,如果银行估价低于叫价,我们要么就是花
时间跟seller磨,让他降价,要么就事先准备一些应急的钱多付downpayment。
后来银行估价出来比我们谈好的价格高了一万,这件事情就顺利地过去了。

如果叫价20 万 首付将回是4万(现在一般LTV不会超过80%)代款16万
如果估价只有18万 那么银行最大贷款只能是18*0。8=14。4万 首付款也就相应增加到5

对了,高手们,我现在也是wells fargo在做我的贷款,很折腾的说。也不知道是我的
broker不够专业,还是银行事情多,今天这事,明天那事的。
而且我的broker到现在也没有给我conditional approval,她竟然说直接clear,我都没
搞明白,只收到从银行寄来的GFE,这个东西有什么法律效力吗?还是就是给我看看的。
我29号closing,我总觉得来不及呢,但是我的broker说来得及。
还有一个问题,我收到GFE上说给我贷款多少,利息多少,可是现在broker告诉我银行
收到我们房子09年上半年的tax税单,09年上半年的税竟然收了55%,而不是往年的50%
,但是银行说要按照上半年的*2算09年一年的,所以就不贷给我那么多了,我就很奇怪
,09年全年的税都出来了,为什么他们还要按照上半年的乘以2呢?
真希望有过来人帮我好好讲讲这一块的东西,如果打字不方便,我可以给你们打电话,

高度怀疑你选的broker不专业。我很喜欢Wells Fargo in-house underwriter,起码打
电话是能够找到人的,而且回答问题很耐心,可以argue,也有取胜的时候。
我现在还没见过没有condition的时候,但是conditional approval文件不给客人倒是
有的,有些银行没有commitment,所有condition都clear了,就可以作为commitment用
。如果LZ的合同上要求commitment,可以去问律师是否有按时收到。GFE只是cost的估
算,列在GFE上的费用的增减是有一定规定的,不能随便乱改。如果银行因为property
tax增加而必须降低loan amount的话,唯一的可能是property tax的增量导致debt to
income的比值超过guidelines的规定。LZ如果不是收入刚刚够贷款的话,这种提法很奇
怪。就算原来每年$10000的property tax,按银行的算法变成110%,多了$1000,每个
月多$80多刀,就因为这点儿钱LZ的收入就支持不住debt to income了???
