上说6月1日CLOSE ESCROW 。我们有亲戚介绍的中国人经纪,作为买方, 我们完全按照
合同行事履行责任, 我们已经花钱做了房屋检查等等,5月26日经纪把一堆文件(EARTH
REPORT, TITLE COMPANY REPORT) 扔过来,啥都没有说,我仔细阅读发现对方不但没
有交地税, 甚至还有两个总价超过38万元LIEN 的,也就是说房子的卖价根本不能
COVER DEBTS, 我向经纪和ESCROW书面提出了我的疑问,他们都没有书面回答我,还信
誓旦旦地说没有问题,他们欠多少钱都和你没有关系。当时心里对对方的人品有了点怀
疑, ,老头老太居然连政府的地税都欠,还那么多的债务,还开好车。 5月28日对方
说发现还有一笔4
万元的LIEN在房屋上,要花点时间处理, 我们这才发现合同上并没有保护我们的条款
:比如现在因为对方的原因导致交易不能按时完成,对方是否要赔偿损失之类。我们没
有办法也只好等待,哪曾想对方居然狮子大开口,6/6/2012 EMAIL 经纪要求我们替对
方偿还17000元的贷款,也就是说房价上升到36.7万(见邮件)否则就不卖给我们:
邮件如下:
I wanted to get in touch with you to let you know that the seller is unable
to secure financing to pay off the remainder of the debt for the 2nd on
their home. They were under the impression that the loan that they took out
for their business was a personal line of credit and not attached to their
home. They will need
the buyer to pay a additional $17,000 for the house if the buyer still would
like to buy it. If not then we will have to put the home back on the
market and sell it for closer to the asking price and then there will not be
a shortage. I am sorry to do this to your clients, but there is nothing
else we can do. Please let me know if they will be willing to pay $367,000
for the home? If not, we will have to order cancellation of this escrow.

我们当然不同意,而且对对方的无耻恶意敲诈行为非常的愤怒,我们自己在这个交易
中也有很多失误的地方,现在向大家请教:我们可以告卖家违约并赔偿我们的损失吗?
最近比较倒霉, 祸不单行,昨晚下班又被别人撞了,对方保险很烂,又有得头疼了。

另外,你说敲诈不准确,根据你的描述,好像你还没付任何钱、签订任何合同给卖方。
看上去,只是他们讨价还价的过程不太地道,你没什么太大的实际的损失啊,除了一些
(无法避免的)时间和机会。

到了最后关头给卖方这么来摆一道,这不是敲诈是什么?

您不用头疼这些事, 这在买房子的过程中不算什么, 您的agent会take care. 当然也不
必告对方, 在美国的官司赢家只有一个, 就是lawyer.

there's nothing special in your case and you don't have a case to against
the seller if you try to fight them in court. you should do your homework
and stop the transaction long time ago. real estate contract has wording/
addendum for title issues. based on what you put here, you either did not
include that or didn't do anything at least not on time. this kind of stuff
happens all the time. no big deal and since you don't really have any real
lost simply move on.

定金肯定可以拿回来。 我们的合同里规定卖方要赔偿买方survey和title search的费
用。你要看你的合同怎么写的。

今天早晨经纪来电说对方竟然不顾程序没有走完就直接把房子又重新放到市场上卖去了
,他给对方发了邮件说要停止这中违反合同的行为,对方只轻描淡写地说这些早在“经
纪评语”就说过了,见邮件。我停止这项交易是肯定的,想请教大家,对于这种情况,
我们该如何处理

不懂我们会那么被动。
Hello xxx,
After speaking with escrow we have determined based on the taxes/1st and 2nd
mortgage the seller will need to sell the home for $365,000 and both agents
reduce commission to 2.5% per agent to make this deal work. Are you and
your clients willing to do that? If not, we have received a offer already
today for $375,000 not asking for closing costs and it would actually net
the seller money to move. We understand that the seller is currently under
contract with your buyers and that the RPA was subject to the Preliminary
Title Report. This 2nd lien has created a issue and that is why we either
need to re-negotiate the sales price/terms or cancel the agreement. We are
very sorry for the inconvenience, but unfortunately there is nothing we can
do except move forward from here. Please let me know asap. If your client
does not want to move forward then we will generate a cancellation returning
the good faith deposit to the buyers.

for your case, yes they can and they have to. otherwise, it will become a
short sale and for that their lien holders will have to approve the sale
before you can close it. it will take 3 to 6 months and you don't even know
whether you can or can not get it since one of the lien holder may not
approve the sale. move on and if you try to fight in court, you will not win
.

你自己已经表达了强烈不买的意向,所以重回市场有什么奇怪的?买卖没结束前,谁想
反悔都可以找到理由。你肯定可以拿回定金,因为按你描述,是对方的错。你也可以选
择高她,要求返还其他花费的费用,比如inspection fee,什么的,如果是对方毁约。
当然,也不能保证你赢。到诉讼期间,她的房子就不能卖了。

退出。

卖主房不抵债,要想close必须卖价高于贷款,否则银行不会给过户
否则就要走短售程序,俩贷款,会非常折腾
你也不用要啥说法,拿押金走人,就当交学费了

有一地产经纪告诉我说超过17天卖方反悔就是违约,告他一告一个准,定金可以双倍返
还。我仔细研究下再做决定,我们老中有时就是缺乏秋菊的精神。

?不多的话就别劳民伤财了。
