11/25/2015: Importance of Comments to USCIS "Draft" Policy Memorandum on
Revised Definition of "Same or Similar Occupational Classification" for I-
140 Portability
The policy which was lately released by the USCIS is just a "draft" and non-
binding draft. This draft is released to seek comments from the public and
stakeholders. This draft somewhat liberalize the requirements for change of
employment with the approved I-140 petition without losing retained approved
I-140. The deadline for sending in comments is January 4, 2016. There are a
lot of pros and cons comments flowing into the USCIS. Those who support
this change or who desire further liberalization of standard for change of
employment may want to send in their comments en masse before too late.
