收到lender寄来的$1000,支票。
上边说:
“We have funded your loan. Based on the review of the Final HUD-1, we
received from the escrow company, currently there is a 10% tolerance fee
violation shown on the 3rd page of the final HUD-1 under "Charges That in
Total Cannot Increase More Than 10%"
Enclosed is a refund for total of $1000 to cure the 10% tolerance fee
violation along with an "Amended" Final HUD-1 reflecting the cure.”
请问版上的明白人,这钱是谁给的?
我们的loan agent说,这是他给的。可为什么是lender给的支票呢?
如果 loan agent 硬说是他给的,而且要算作他应给的commission rebate的一部分,
这合理吗?我该如何核实呢?

我自己查了一下。
Curing a tolerance violation involves: (1) reimbursing the borrower and (2)
revising the HUD-1. It is the loan originator’s (Harry) responsibility to
reimburse the borrower the amount by which the actual settlement charges
exceed the permitted tolerances.23 Although the loan originator is
responsible for reimbursement, the loan originator may authorize a third
party (including the settlement agent) to send the reimbursement to the
borrower.24 Even if a seller or person other than the borrower pays for a
settlement service, the loan originator or a third party authorized by the
loan originator must reimburse the borrower for any tolerance violation that
might have occurred.25 Under §3500.7(i), a borrower will be deemed to have
received timely reimbursement if the payment is delivered or placed in the
mail within 30 days after settlement.
这是不是说,这是loan agent 给的refund. by law。
这个和buyer agent 的commission没什么关系。

是啊。
因为loan agent是buyer agent的弟弟。
反正这钱by law,他必须给,他就说是从姐姐的comission 里出的。
这是用一家人的弊端。

Broker's commission is fixed. it will be mailed to the office by different
system, not mailed it to the borrower. Are you using borrower paid or lender
paid system? Most of the brokers are using lender paid option, which means
broker's commission is fixed.

Are you using borrower paid or lender
paid system?
这个问题是问,loan agent 的钱是谁付的吗?我们从没付过钱给broker.所以我想应该
是lender paid.
这是不是说,lender 给我们的那个cure 10% tolerance 和broker,agent都没关系?
给lender 打电话,发email问这事,没人理。可能觉着给支票就拿着,管谁给的干吗?
