各位美妈，
我知道美国有法律FMLA要求给孕妇最多12周的产假，但是FMLA只对拥有大于50的员工的
公司有说明。我的公司没有50个员工，我不在乎有没有工资，就是想多休息在家照顾孩
子，所以问问有没有美妈知道小公司的产假是怎么回事？是不是只要老板同意，我就可
以想休多久就休多久（譬如15周）？因为我是H1B,所以不能就不上班了。
FMLA Eligibility
An employer in the state of New York must have 50 employees working in the
business within a radius of 75 miles to offer maternity benefits under the
Family and Medical Leave Act.

I don't mind not getting paid. I just want to make sure I can stay at home
without paying and not effecting my h1b.

小公司很 flexible，就看你跟老板怎么说了
我提出休2月，我老板主动提出我的PTO用完后，剩下的三周给我带薪
MM要休15周我觉得有点多，一般小公司人力都比较缺乏，呵呵
12周应该没问题

我刚才又查了查，发现除了12周产假外，还可以申请medical leave for 12 weeks, 譬
如说需要卧床保胎。虽说俺身壮如牛，不知道有没有美妈曾经还另外申请了medical
leave.

EDD (Employment Development Department) will pay you 10 weeks in total (4
weeks before expectant date and 6 weeks after birth). You will be paid by
the State for approx. 65% of your normal salary. also, it is tax free. :)

EDD is for CA state. Unfortunately I m in ny. But I see we have disability
insurance. Although it's $170 per week, it's
better than nothing. I will see if my ob approves it.

H1B最多只有12周的unpayed leave吧，就是说带薪的假期结束后，你可以不带薪再休三
个月，只要你公司同意。

In CA, you get 6 paid weeks after delivery (8 weeks for C-section)through
disability isurance and another 6 paid weeks through Paid Family Leave
program. I had about 5-month leave with the first 14 weeks paid by the state
