Actually there is a way to work this out.
In the contract, specify that certain hours of time the nanny is not on duty
, not on call, so not getting paid.
Specify an hourly rate the same as the minimum wage.
Write in the contract that the room and meal is provided as the benefit to
the nanny, and a credit to the payment due. You can say you do not require
the nanny to stay at your home when she is not on duty/call.
So the cash payment could still be limited around $3000-4000.
Every time when you pay, print a paper listing the hourly rate, and
the number of hours she worked, and ask the nanny to sign it.
