I recently received a written warning (performance issue) from my boss and I will be re-evaluated after 2 months. My question is: will prospective employers be able to find out this written warning when they talk to the HR for my employment information in my current company? Thanks for your input!

On the contrary, if HR has any obligation in this regard, they're not allowed to disclose ANYTHING NEGATIVE about your performance to your potential employers, or any outsiders, to avoid potential legal liability.

This is a good point. However, I heard some employers will ask a question: "is this person rehirable". If HR's answer is "no", then I am screwed.

You forgot to count in those PERMers whose PD were between Feb - July but missed the 07/07 boat. At least a few hundred of them, including me.

From historical data, it does not seem that pd between Feb and June is a big problem, since I think the increase of July number is due to NIW. perm based do not have the luxury to file 485 in a so short period (6/10 to July).

I think it will be risky to wait until they fire me. Again, it's very hard for me to find a new job in two months but I cannot wait until they fire me.

one point to make clear, 07/07 WAVE mentioned I485 with old PD majority, not the PD in 07/07 07/07 PD was about 1500-1700 EB2C. it is the peak compare to 700-900/month at the end of 2006 and beginning of 2007. the famous of 07/07 is you can submit I485. there are tons of I 485 submitted from July to Aug with PD 1999-2007/07 for EB3I,EB3C with PD 2003-2007 EB2I and EB2C and tons of EB2Row. It may be more than 300000 I485 submitted during this time. this is the PEAK or WAVE for 07/07 As I knew, more than half of 07/07 was NIW (Perm cannot catch it as it need time for advertisement, if you save there are wave of Perm in 07-12/2008, I would say yes) and most of EB2C(NIW) went to EB1 and got GC (think about it. you can get NIW pass with preparing documents in 1 month and approved later , you have the ability to go EB1 sooner or later)

if it's just perfermance issue, many decent companies will not fire you; they will more likely persuade you to leave with a package, and you can get unemployment benefit if you have green card. Do not resign before making this clear.

You're eligible to rehire in most cases. You can do a little research yourself see what is not eligible to rehire.

They claimed it's performance issues. But I don't think so. I got the written warning the same day when I requested more staffing in my team (a new manager in the other team got more people under him than me although I was here in this firm much longer than him).

My boss is the CEO and I directly report to him (so the written warning is from CEO) so I will just let it go instead of explaining or fighting back.

report to CEO. Then the letter is final by any mean. But you still can try to get a package.
