刚搬到新房子,什么都不懂,有问题在此请教各位了。昨天厨房插座没电了,老公就把

通常是插座有问题,换个新的就好了。如果不确定是哪个插座,多换几个。

买个万用表,一个一个插座,一根一根线查
我的炉子曾经不能用,我怀疑炉子坏了,总闸开关坏了.....排除了好多原因,最后查
出来插座有一条线没电。
拆开插座发现里面接线是有电的,百思不得其姐,又装上,就好了,可能就是里面线松
了而已。

No. The report said the police followed the car here. If Mr. Luo could
find witness supporting that he did not go out at that time, or drove his
own car to buy the tools, that would suffice to defeat the police's
credibility because it contradict with the police's statement.

从另外一个帖子的陈述看,在警察到达的时间附近,罗先生的确出去买东西了,但是他
声称自己开的是工程车。如果这一点能有人证证明,那警察的说法就站不住脚了。
赃车内有没有罗先生的指纹这点也很重要。为什么警察不验指纹呢?
有没有赃车的钥匙倒不重要吧,贼未必用拿原车的车钥匙去偷的。

应该是没有时间一直开着赃车被警察跟着。
在警察报告中所说的,警察一直跟赃车到抓人的地方,这里应该是一段时间,而这段时
间里,同行的工人和屋主都作证见到当事人一直在屋内工作。
当事人之前开自己的车买东西回来以后,一直在屋内工作,没有离开过。警察看了发票

检察官还是控罪了,只不过把重罪改为行为不检。
个人觉得警察坚持不验指纹就够说明问题了。检察官也应该是心里有数的。

It's kinda mind boggling to think the PD lost sight of the suspect driving a
stolen vehicle after following him to a dead-end street. I mean, that
doesn't make sense, someone must have driven that stolen vehicle to that
parking lot right ? Unless the cop lied about following the vehicle in the
1st place....which would make some sense, but what would motivate something like that ?

of sudden, there was one matching a reported stolen car! Bingo! He was so
excited that he wanted to make his case even bigger ... not only found the
car, but caught the thief as well. He called for backup and started a
routine knock-on check of the nearby residents for possible leads. However,
Mr. Luo was not cooperative! And he "looked suspicious" because he did not
speak English! He was so mad at Mr. Luo that he wanted to use the old

surrender his ID and wallet and threw them into the stolen car. Okay, he now

far stretched, especially when it might involve couple of his fellow

那你怎么解释Van里面还有其他工具?警察要放那些工具比放个皮夹子难度大的多。。。
那个警察讲了:因为Van后面的玻璃很黑,无法看清Van里面的动静,我认为警察在远远
的等其他支援的车,等别的车到了,才走近发现Van里面已经没有人了。就是有可能在
这段时间,那个罗先生走出车,进到车库而未被警察看见(可能由于警察角度问题)。

这就是不可理解的地方了。据罗回忆,应该是3个警察把他押下来,控制住以后搜身,
拿走他口袋内几乎所有的东西。3个警察啊,如果有一个松口的话,栽赃这够坐牢的罪
了吧。很难理解。

the cop already stated in the report the reason he didnt follow the car to
the parked space is he knows its a dead end street. All he had to do was to
wait at the exit of the dead end street for backup. because its a dead end
street,.i.e. the van cannot go anywhere!

MR. LUO 在一个错误的时间及地点出现了,就这么简单。
有几个疑问:
1. SALES ORDER SLIP当时是在LUO的身上吗?
如果不是的话,怎么出现在车上?警方又是从哪里拿到这个证据的?
如果是在LUO的身上的话,应刻是当天买的,应该有时间在上面。如果是LUO去买的话,时间上可以看出来他出去的时间与警方跟踪的时间是不是对应。
2. 同时ARREST的另外两个人为什么没有这么大的嫌疑?要栽赃的话,为什么没有那两人份?
律师说的是对的,现在只能找个私人DETECTIVE去找找其它线索,能不能证明偷车的另有人,想证明警察做假难度太大了。
话说回来,这个律师这种CASE收个6000的一点也不贵。
题外话,对付警察一定要冷静,一定要合作,不能认为自己没有做错,感觉受到伤害,对警察抱有敌对态度,这样的话很容易小事变大。

有时候也难说,人们常说偷车的都是老黑老墨啥的,肯定不会跟棒子联系起来
棒子没这个名声
但我当年的车就是被棒子偷了,最后被警察找到后几个证据:

Some guy here learned something called probable cause from watching TV shows
and thought himself an expert on this. This is dangerous.
Let me be clear. There is an exception to the warrrant requirement, called
automobile exception. To support a validity of a warrantless search under
this exception, however, you nee to meet three strigent requirements:
1. The vehicle is in a public place. This requirement is met here since the
van was parked on a public street.
2. There is probable cause to believe contraband or evidence of crime can be
found in the vehicle. This is probably met since the van was stolen and the
police may believe he could find something inside the van related to the
car theft.
3. The vehicle appears readily mobile. Here is the problem. The police
officer in his report said the street is dead ended. There is no way to move
the van out from the dead end. The police parked at the open end and called
backup. If the driver attempted to move out from his side he would be able
to stop him right there. The officer said the van was unoccupied at the time
. This should be the focus point to get all the evidence thrown out since
the van was not readily mobile.
An experienced officer would stark up and wait for the driver to move the
car so that he can search it without a warrant, under the same situation.
The correct police procedure should be to impound the van and do an
inventory search, since the van is stolen, hoping to find something. Or, get
a warrant. Automobile exception does not apply and the search is illegal.
Without these evidence, how could the DA charge Mr. Luo?
What about other exceptions? There is no exigency since Mr. Luo was detained
by the police at the time and the van was unoccupied. Mr. Luo did not
consent to the search. Even if he did the consent is invalid since the van

I have two questions:
Where was A's pickup? If A just arrived, his pickup's engine should still be
hot. Definitely the stolen car's engine was hot too. All parties missed
this evidence.
Second, it will be normal that the police officer took A's ID first, then
cuffed him if the officer though he was a suspect, then searched his body
and took belongings as evidence. Searching A’s body without cuffing the
suspect first is wired, also dangerous to the police officer himself unless
the police office already decided to frame A.
