我记得考古看到 靠谱男老兄说可以用expired的I-797再去renew。
律师回复说是不能renew而且需要离境。

No, you won't be able to renew the H-1B if the I-485 is denied. You'll have
to leave the country and then try to apply for a non-immigrant visa from
outside of the US. This is the risk in letting the H-1B lapse. Note, however
, that there is no reason why the I-485 should be denied so I doubt that
this situation would arise.
I normally leave the decision to extend the H-1B up to the employee/employer
when the I-485 is pending. If you believe that having the safety net is
worth the expense, we can definitely do it. If you don't think so, you can
continue to work with the EAD/AP. In the event of the latter, you must make
sure to keep the EAD valid at all times!!
