As you all know, recently the RFE/NOID rates have hiked dramatically in NSC
area, for the persons who contact Da Mi also hike in August. Now today
according to the ALIA discussion, it maybe the reason that EB1 quota has
almost been used up, so that it "could" cause the USCIS, especially NSC
center, to put on stringent requirement on the EB1A/B. TSC by far still
maintains good passing rate, either passing one time or after RFE. However,
in NSC, you need a big effort to pass.
Therefore, unless your case is super strong, e.g. (25+ paper, 400+ citation)
, Da Mi will highly recommend that folks here put on hold your EB1
application slightly for about 1 month. Taking advantage of this one month
to strengthen your preparation materials, waiting for more positive things ,
e.g. more review, more citations, to come out before your submission. If
you can't wait, do the concurrent filings , but I will suggest you not to PP
under such condition.
Even though there has no any other proofs that the killing rate in NSC is
linked to VISA shortage, it does seem that too many people have got into
trouble with NSC, especially 0002. In the last month, 2 more folks( 1 1A, 1
1B) have reported to da mi that got denial letter issued by 0002 since my
update last time. 1A case did have strong background, 1B case not that
strong but should have passed in normal condition. That means, it may not
be completely correlated whether you are strong or not, the shortage in
handling or some other factors rule right now.
