Hello,
I am sorry, but the item was not shipped in new condition. I was not
referring to the shipping box. I am referring to the ITEM BOX. The item box
has CLEARLY been opened previously. As with all packages that I purchase
from amazon/online, I recorded opening the package and took several
photographs. The photographs clearly show that the seal to the item box has
been manipulated. I did not even bother attempting to open the seal on the
box and view the contents of the item box. I have clearly and meticulously
documented by video and photo the condition the package and item box was
received in (a couple pictures are attached to this email).
This item was listed as being 'new', not in like-new condition. This is in
violation of Amazon's Condition Guidelines -- you cannot list an item,
especially a computer as anything other than "Used - Acceptable" once the
seal to the item box has been opened/manipulated.
As far as issuing a partial refund in the amount of $100.00, I refuse to
accept this as it is indicative that I accept the package in 'said'
condition. This is more or less an admission of guilt on your part and I
refuse to accept nothing less than a 'brand-new' in the box, sealed package
as was listed on amazon.
In terms of a 20% restocking fee, this is laughable that you expect me to
accept this or intimidate me into keeping the item as you clearly and
fraudulently have misrepresented (whether knowingly or not) the condition of
this item. IT IS NOT NEW IF THE SEAL TO THE BOX HAS BEEN COMPROMISED. ALSO,
I would like to point out that I have NOT OPENED the item box, only the
shipping vessel. The 'refund' policy posted by YOU explicitly indicates that
"。。。。"
The item box was never opened by myself and I have video evidence supporting
this. After opening the shipping box I only viewed the seal on the item box
and decided I want a refund. Thus, this item does not fall under the
guidelines of your own return policy.
You are responsible (legally, morally and according to the Amazon seller
guidelines) to provide the item in said condition to avoid situations like
these. As you have misrepresented the condition of this item (whether
knowingly or not), I expect to receive not only a full refund for the item,
but to receive in full compensatory shipping & handling related expenses
inclusive to reception and return of this item.
I am further taking action in the form of social media and forums. I have
posted several posts referring to your seller handle and the
misrepresentation of the item received. I am also considering taking action
through the Better Business Bureau.
I would also like to point out that this transaction is covered under the
Amazon.com A-to-z Guarantee as this item falls under the category of two
points covered by the guarantee:
#1. - "The buyer purchased an item using the Marketplace Payments by Amazon
system but never received the item they ordered." ( I ordered a NEW item,
not a new-like-used item in which the seal on the box has been opened/
manipulated. I never received the item I ordered).
#2. The buyer received the item, but the item was materially different than
expected and depicted in the seller's description. (I received an item, but
it was not the item I ordered, it is materially different from a new item as
it has been previously opened before I received it, thus it is NOT the same
.).
I request that you process this return immediately without delay and demand
that you provide compensation for all shipping and handling related to this
transaction, this includes shipping and handling costs in the obtaining and
returning of this item.
