不是6%吗？不过呢，看你兄弟跟你关系怎么样了，
搞不好一人雇一个律师，亲兄弟明算账了，要不
为空调修不修，天花板上漏过水之类的事吵起来
就不好了。

What is the process for buying a house without a Realtor?

I would like to purchase a home from a family member. There is no need for
a listing agent or buying agent because of the nature of the transaction.
I assume to start the process by speaking with a real estate attorney and/or
title company.
Thanks for the help!

By all means hire a residential real estate attorney. The legal
consequences from mistakes occuring during the buying process can lead to
some major headaches. An attorney who specializes in residential real estate
will review your contract, work with your mortgage loan officer, and make
sure that dates are set for home inspections, mortgage commitment and other
contingencies.
An attorney will also review important documents, including the deed, legal
descriptions, mortgage loan documents, and title. The attorney you select
should also attend your closing.
Only an experienced professional, who is closely familiar with these
documents, can catch problems that will save you future expenses to correct.
It's good to have someone experienced looking out for your legal interests.
Costs for an attorney can vary. Some attorneys charge a flat fee from
contract to closing and others will charge an hourly rate. But, before
proceeding, ask for a retainer agreement that outlines the attorney's
charges and responsibilities in detail.

Drew makes a good point. You can always hire a Realtor to do your paperwork
and closing for a flat fee. I bet it would cost less than you think.

I'll make a bold suggestion to hire a Realtor, but only pay a flat fee for
paperwork and guidance. Yes, an attorney or title company will help you
with the closing details and the paperwork, but I think a Realtor will be
much, much, much more proactive and knowledgable in guiding you through the
loan process, the inspections and all other due diligence. Not that an
attorney can't handle it, but on a day to day basis, those piddly details
are not their ball of wax. Also, it would be much easier to reach a local
real estate broker on off hours or weekends than it would be to ever talk
with an attorney.

That was a great answer Gwen. One more thing to consider when buying from a
family member is your mortgage financing. Did you know that you could
purchase a home from a family member with no money out of pocket? It is a
gift of equity purchase. Both parties will have to agree on this type of
financing. But it is a very common type of mortgage transaction.
The amount of funds out of your pocket will be determined by the agreed upon
sales price, appraised value, the current use of the home (is it a family
members primary residence, second home, or investment property), and if you
already occupy this property.

I'm not sure what the custom is where you live, but in my area, we use
closing companies instead of real estate attorneys to do closings. If you
agreed to use the closing company, I bet they would help you through the
paperwork. If you're getting a loan for the property, then you'll definitely
need a closing company or attorney; on the other hand, if your paying cash
or some other arrangement, it's just a matter of having an written agreement
and recording the sale...I know all my real estate colleagues will cringe
when I say that because it's usually such a complex process.

If there are no surprises and the transaction goes smoothly: Contact a good
real estate attorney to prepare an Agreement Of Sale as you should have this
done as well as to coordinate and obtain all necessary documentation for
the closing. Contact a mortgage lender if you are obtaining a mortgage.
Contact property/wood infestation/ radon/etc. inspectors if you are going to
have inspections. Contact local government authorities to see if an
occupancy permit and a sewer dye test are required by them and any other
requirements that they may have. You can do it without real estate agent
involvement. I have represented transactions between family members that
were easy. I have also represented transactions between family members that
were extremely difficult and the parties were glad to have had my assistance
.

昨天朋友给我打电话，买了半天房CONTRACT都签了，卖家说他没有TITLE，
结果就HASSLE起来了，我说还罗嗦什么，直接告他们欺诈
