It all denpends whether you rent from apartment lease office or private
person. If you have not sign a lease but put deposit, you should be able to
get it back as long as within 72hrs (usually this is the case for rent from
lease office). If from private person, I think you may need to discuss
depends on the condition. Usually if you sign a lease, lease office usually
gives you the notice of old paint stuff thing. If that's the case, tt will
be difficult to get it back. Not sure what is your case.

by law, landlord must inform you about the lead. I think you can refuse to
sign the lease and ask you deposit back if you don't want to rent this house.
By the way, lead paint is not that dangerous, unless you are directly
exposed to it. Too many houses in the bay area were built before 1978. It is
highly likely the house has been painted many times since then. The lead
paint is most likely buried many layers underneath the new paint. As long as
you don't drill into it intentionally, you are OK.
It is landlord's mistake for not giving you the disclosure, but this doesn't
mean the house is dangerous.
