美国前宾州州立大学华裔助理教授陈永生声称，因族裔和国籍因素使他未能通过该校能
源和矿产工程系的“终身教职”审查，因此控告该校种族歧视和违约。
陈永生1994年毕业于中国清华大学材料系，2003年取得宾州理海大学(Lehigh
University)博士学位，2007年受聘在宾州州立大学地球矿业科学学院任助理教授。他
的律师莱伯11日向联邦地区法院提出的诉状指出，他的终身教职一案遭否决是因他的种
族背景。
据报道，莱伯说：“陈永生教学成绩卓越，与非亚裔同僚相较，有过之无不及，并可明
显发现，宾州州大该地区教职人员多数是白人。”
诉状中，莱伯列举一些与陈永生同系或同院教授，其资格不如陈永生却都取得终身教职
。陈永生2013年2月的申请案遭否决时，审查委员会曾说，他以首席作者身份发表的研
究报告不足。陈永生自受聘宾州州大以来，曾发表22篇专业论文。
诉状说，审查委员会怪他只是一篇论文的首席作者，其他论文都是多名作者之一，因此
无法判断他在这些论文的“真正贡献”，“但此评断出于捏造和武断”。莱伯说，在陈
永生的专业领域，许多人共同著作论文是普遍现象。
莱伯还说，陈永生曾亲自面见该学院院长伊斯特林，指明在这些论文中他做了什么贡献
，对方当时告诉他，他应能获得终身教职，但最终并未更改。事实上，他向教职人员议
会提出的上诉，于2013年5月再度被否决。
诉状指控，该校审查终身教职时，在美国出生的白人教授的审核标准不像陈永生的一样
严苛。诉状要求该校赔偿应付薪资和情绪损失，陈永生已在香港谋得新职，不久后将返
回中国，但为了子女就学问题，他家人将留在宾州州立大学城(State College)，诉状
指出，陈永生符合终身教职的资格却遭该校否决，导致家人分离。
宾州州大发言人莉萨·鲍尔斯说，该校对此诉讼不予置评，但该校“对终身教职审查程
序有信心”。

Chen, an assistant professor of energy and mineral engineering in the
College of Earth and Mineral Sciences, was denied tenure in January 2013
after five years at Penn State.
In his 25-page filing, attorney James Lieber, of Pittsburgh, trumpets Chen’
s accomplishments, such as receiving the Defense Advanced Research Projects
Agency Young Faculty Award and his extensive body of research. But he also
points to other people’s work, detailing — project for project — the
accomplishments of white, American-born faculty members granted tenure.
Chen claims 45 publishing credits, including 22 peer-reviewed articles
during his time at Penn State as of the tenure decision. Just one of those,
however, listed Chen as the first author in a field of multiples. The suit
claims the university said it was impossible to ascertain the “true extent
” of Chen’s contributions to the projects.
Lieber referred to three other professors for comparison, claiming that the
one white male and two white females were given tenure despite having fewer
publications to their credit. However, the plaintiff’s own statistics show
that at least two of those professors were the first authors on a larger
percentage of their body of work.
According to a letter cited in the filing, Dean William Easterling told Chen
in 2012 that he was pleased with the professor’s progress, but added “I
strongly encourage you to concentrate on submitting first author-manuscripts
and publishing more with your own students.”

没提他拿到多少房顶。说实话，一篇一作确实少了点。
不过我支持他的起诉。大学教职的升迁也有隐性的AA.在很多大学里，一个黑人PH.D是
学校极力扶持，保护，争取的对象。黑人PHD,特别是黑女PHD,不管科研多烂，肯定有无
数学校抢着要。评tenure的时候dean都会给委员会打招呼。另外就是人缘关系，帮派。
这个美国和中国类似，有人的地方就有江湖。

说实话，一篇一作确实少了点。
--- Depends on the research area. I am not very clear about his area. Using
the naming sequence on a paper a a rule of thumb is something quite damaging
to the research field in general. It kills collaboration.

这个看学校。像Penn state这样的学校，tenured associate professor就应该是学术
带头人。也就是有独立领导科研的能力。合作可以，但必须在一定数量课题中担任领导
角色。

much appreciated among public schools other than sports :)

我很支持他告。
但是退回来说，就看到你的这个单子，虽然我不是做工程的，我觉得他有点弱。
和别人挂名字发文章是没有错的，但是如果自己不是通讯作者，是没法justify
scholarship.....一作都意义不大，理论上，当个教授，是该培养学生出一作，而不是
自己吧。。。。。。。。。。。没看到一篇是他是通讯作者啊
当然如果他们系别的白人黑人教授也是这个水平，就另当他论。不过我记忆中psu是公
立大学里tier one系列的吧，难道其他老师都是这水平？
