receiving date: 4/10
notice date: 4/18
I'm in MD.

我的是生物博士后，老板没钱+要搬到别的州，我的H1B 在9/30/12 过期了。现在有老
板要我，我的问题是：
1. 我可以在美国申请H1B吗？
2. 我LD是H1B，如果我不能申请H1B，我可以申请H4吗？
如果我在美国不能申请，
3. 我可以回国去签H1B或H4吗？有什么风险？会不会回不来了？
另外我的NIW I140 在2011 年10月批了，H1B也将在12/18/2012 满六年了。
各位大侠帮忙，先谢谢了！

可，但很可能要出境签证激活
很可能被拒，但是不排除给你个出境激活的机会的可能性
可，有风险，你毕竟overstay了这么久
不给你签证当然你就回不来了，除非你LD 140批了然后她递485给你境外CP
有一个批准的140, H1b不受六年限制可以任意延期

只要不超过180天，是可以申请的

这是我咨询的律师给我的回信：
I believe you have to go oversea for either H-1B or H-4, have no other
choices. You have to go ASAP because if you overstay for 180 days, you can'
t adjustment of status even if you I-140 become current.

搭车问一下，学校iso能查的那个状态改变是在哪一步出现，
是lz的

你的H1b失效了这么久才来这里求助？这期间，你没转H4 ？那就是黑身份哦？这事，可
大可小。
我的理解是，新雇主给你办H1b transfer 的前提是，你目前的身份是有效的（目前雇
主还没有解雇你或者还没有给USCIS递交解雇备案材料）。简言之，从一个合法身份，
转到新的合法身份。但是不可能从一个非法身份，转到一个合法身份。新雇主HR在给你
办H1b的时候，也会索要你目前的H1b approval notice，一看都失效了好几个月，咋整？
你的H1B 在9/30/12 过期，如果在此之后，你仍在现在这个lab干活领薪水，那么就是
非法工作。我不敢保证，会不会对你下一个H1b工作有影响，但是肯定会影响你的驴卡
申请。
建议：
1，赶紧转H4；
2）赶紧回国，拿到offer之后，再重新申请H1b入境；
不对之处，常委们补充。

I haven't checked with my school yet. But I think at least wait till mid May
to worry about it.

I think VSC is still mailing out all the notices. There is one other co-
worker applied for H1B in my company this year, and we both all the letters
today. I think being patient is the key here. Good luck !
