A scientist discovered a new drug that is much superior than a similar drug
currently on the market from company A. Before the scientist publish his
discovery, he shorted the stock of company A.
Does that constitute "insider trading" or any fraud under other names?

same thing, man! because scientist is outside of A not inside.

If he is working for one company, it's O.K. to short competitive's stock,
probably not O.K. to buy its own company's stock.
If he is independent, it really does not matter.

I see.
So a professor in a university could do whatever, even if he knows something that is not public.
