亮。
不过等国女自己请月嫂被黑了就不大叫这种普世法律多么好了

我的感觉美帝法律总体来说是牺牲公平，但和稀泥，尽量别弄极端就好（比如穷女拿不
到钱）。

先说一点：楼主讲的是法律，而不是评价，所以我说的月嫂和法律问题跟楼主说的没关
系，不是一回事儿。
月嫂是利用漏洞，毕竟雇佣关系和夫妻关系是没法比较的。所以你这类比也不太合理。
按劳分配和现在这种照顾弱者的法律其实大同小异，因为出现问题时都是定价问题：
按劳分配，劳动怎么界定？端一个月盘子，是该给3000美元还是2000人民币？哪个合理？
照顾弱者的法律存在问题就是——怎么界定弱者？是累死累活的马公麻婆，还是累死累
活的月嫂？
所以我觉得都差不多。

月嫂和lz所幻想的都是一种立法理念，就是所谓照顾弱势群体
月嫂相对马工在美帝看来就是弱势群体，所以会有那么一个结果
在lz看来带着孩子的女人相对一个工薪收入的男人，lz也认为女方是弱视群体
在上述中，所谓强势一方的利益被赤裸裸的剥削，就是为了养活这些利用所谓普世法律
来为自己谋私利的行为

但问题在这里：
这种普世法律理念，的确不见得比其他法律理念差吧？
只要是法律制度，就一定有人abuse对吧？
美英的法律理念，还是强于苏联那种党大于一切的法律理念，以及穆斯林世界的以宗教
为法律理念吧？
不是说美国的法律理念合理，而是说现在暂时没人能提出并且实现出更好的，所以只能
凑合着用。

我没有表达我的什么理念，我只interpret 一下相关法律，因为有苦主说一回国，美国
法律就拿他没有办法了，付不付child support 纯粹根据他个人意愿了,或者道义。

但是我不能理解有的人为什么要evade child support obligation . 难道作为一个父
亲，不应该去挣钱养活自己的孩子吗？
前段时间看到家版一个猥琐男上来问前妻和一岁多的孩子跟她离婚回国了，他应该付多
少抚养费，言下之意，自己已经很慷慨了，自己是净身出户，不过这净身出户跟无产阶
级差不多，总共存款一万多美元，前妻带走了，猥琐男是自己刚找到工作，以前可能是
学生。好像说一个月给1000？人民币就够了。
其实国女是不错的，无心为难这个猥琐男，或者不懂法律，没有精力恋战，

“我不能理解有的人为什么要evade child support obligation”
这个我倒理解。
第一，缺钱呗！要是一年赚100万，这点钱当然不在乎；
第二，猥琐呗！这个更好理解；
第三，一旦换别人了，会受到来自新家的压力不是？新夫人肯定想多截留下来钱不是？
第四，看前妻。如果前妻是正经人，那还好；就怕那种给钱也是打水漂，花不到孩子头
上就惨了，时间长了，谁也不愿意填无底洞。
说实话，我觉得美国法律在婚姻上还是大体合理的，只是强迫性太强，让人感觉很不舒
服，甚至抵触。

这个男的如果收入降到税前6万，请问楼主，每年仍然付10万alimony和child support
，是否合理？

1. 男的年薪税前20万，每年付10万alimony和child support的可能性很小。
2. 由于男的挣钱能力发生长期变化，当然可以调整alimony，alimony 对于年轻的来说
，只是一定阶段的Support，过后就没有了，很少有终身的。
可以到许多州的网页上去计算child support，没有多少。

如果老婆没有工作，
Alimony to 老婆 3000/ monthly
Child support ( 1) child 1800 / monthly
Total 57600 / year
Alimony is tax deductible , the recipient has to report it as income
Child support is not deductible , but is not taxable income to recipient
either
You can file a motion to modify alimony or child support should your income
changes, but the court would include your other financial resources in
ruling on your petition.
You need to quickly find a job if you do not want to exhaust your other
asset ( bank savings, stock investment account , houses, etc)
After all your assets are exhausted and you are still unable to find a job ,
I mean you are penniless now.
Modification would be granted, you are subject to the minimum child support.
If you are unable to pay the minimum, you go to jail.

还可以问前妻要child support
这里为啥都先假定男的赚钱多，女的赚钱少或不赚钱，女的一定是抚养孩子的一方
现实中很多是反过来的。比如我税前就比我LD多，离了理论上我还可能付他Alimony呢

Child support is very different from alimony.
Some people step in this argument boldly without knowledge that these two
are different issue.
Child support would be modified down under extreme circumstances in some
states. I am taking about common sense.
If you are over 18 , you are required to pay minimum child support by law no
matter what you do. Even if you are disabled, child support would be
deducted from your disability benefits.
If you are penniless 身无分文，as I described in another post , you are
subject to minimum. If do not pay the the minimum the court ordered , you
will be held in contempt to court order and go to jail. PERIOD.
I post a link in my other posts regarding the jail issue, go to read it.
I am not 抬杠。 they are just simple facts . You can even get this
information from internet if you do not know this from other sources.
The people here is very hard to communicate now. 就象农民一样， because
could not understand, then refuse to acknowledge the facts. No matter what
evidence is presented, 就只会瞪着眼睛摇头，俺们那疙瘩不是那样的。
The law would speak, anyway.
People not at the same intelligence level could not make a couple. If they
do, it is not a happy one. Not understandable.

这个女人我在前面的帖子里面已经说过了，就是那种外F思想，“老外都浪漫”，“外
国特别保护妇女和儿童”，“离婚了女人和孩子可以把前夫榨干榨到死”。
你跟这种脑子和思想都不正常的人，讲什么都讲不通的。她那个脑子和思维已经固化了。
举例，她说child support是完全不能逃避的，如果一个人失业，那就从失业救济上面
扣，如果失业救济结束，就进监狱。这不他妈的胡扯吗。我听说我校友年纪轻轻就脑中
风，丧失工作能力，按她这种说法，那我校友就是坐牢的命了。这显然不可能，全世界
，没有哪个国家会制定这样的违反人类基本常识的法律。可见这种外F思想的女人真的
是不能打交道，完全不可理喻。
再次强调，美国是一个讲究“程序正义”的国家，要调整赡养费，或者child support,
都必须通过律师和法庭，这样才不会有法律上面的麻烦。而且美国法庭的管辖权也是有
限的。

你简直有点神经病，生活在自己的愚蠢的梦想里面，还这个国家怎么样怎么样，真是
ridiculous。
老美，或者整个西方国家的男人女人，从初中就开始乱搞，你说这样的感情能有多好多
稳固，你说老外男人或者女人为了一个这样的配偶，能生死相许，不离不弃吗？何况太
多的老外女人就是做了妻子还是极其放荡，象加州，妻子跟外人偷情生的小孩还得亲夫

争论她也没赢，child support当然是可以调整的。众多海归在美国挣10多万美元一年
付的child support,和海归后事业没起色，月薪4000人民币付的child support显然不
一样，这还需要用脑子想吗？用屁股想都知道。
只是你一定要履行“程序正义”，通过律师和法庭来调整。对老实的老中而言，花点钱
找律师去法庭不是很平常的事情吗，老中付child support一般都是老老实实地按照法
律来付的，反倒是这个luowei津津乐道的外国人，很多人都是反正没钱，拍拍屁股一走
了之，才有可能有麻烦。我不知道这个luowei不去外国人的圈子里混，来中国人的论坛
写些没用的东西干嘛。

你这个什么minimum child support显然又是胡扯，举例，一个人出车祸了，全身瘫痪了
，只有点medicare和social security的benefits,那这个人因为付不起minimum child
support就该坐牢了
？这不胡扯吗。
法律所针对的，都是有钱不付的。老中一个个都很老实的，很少到这种情况。

你说的1-3也不是automatically，是要有法庭判决的。
3)中, 很多州规定 child support lien是不能放在自住房上的。
Laid-off了，应该尽快向法院申请调节抚养费。

不会啊，行文很流畅啊，读起来朗朗上口。句子段落连接词，句，都挺不错的。
有值得学习的地方。

Do you believe they really know what they are talking about?
I am using English in this thread b/c some terms are easier to understand in
English.
In the past, I got perfect score in TOFEL without taking class from New
Oriental School.
At present , I have just through an examination conducted by a panel of six
members. All of them used to be attorneys. No one had any comment on my
English.
Well, people here who are so calculated on minimum child support required by
law say my English is not good enough, maybe, but English has never been
an obstacle for me to obtain my degree, to get a job and to be moved up to
my current position . That is enough.
I just could not understand anyone who could be so calculated on their now
children. At the time of separation, as a non custodial parent , you are
already emotionally indebted to your own child. You are not thinking to work
harder, to make more money , so you can pay extra to let your child have
more financial resources. Instead , you are thinking or looking for any
possible excuses to lower the child support.
A lot of people are talking about African Americans , latinos and proudly
stated they are better than them . Most people here are professionals or
professional to be , you can degrade yourself to the those group who live on
welfare. Maybe, it is not degrading, it is where you spiritually belong to.
I personally know one or two women who are struggling for their lives after
divorce with young children. At the time of divorce , they did not hire
attorney to fight for the best interest of their children and themselves
because of ignorance. I can feel their pressure. I am not speaking up for
my own interest . I may even be the paying party in the future b/c of my
income, but my position and my heart do not shift to the point where my
interest stands.

你怎么这么悲愤，莫非你被老外抛弃了，老外不付child support,所以你极端悲愤，觉
得女人都是圣女，男人得象供神一样供你一辈子？
你难道要为加州那些淫荡的美国女人，墨西哥女人，当她们跟外遇生完小孩后，按加州
法律老公还得为不是自己的小孩付child support，你要为这些女人呼吁，就因为这些
女人是女人，所以那些可怜的美国男人要把她们当神供养？
你英语这么好，怎么不去老外的论坛，对那些不付child support的老外宣个讲搞个讲
座什么的，在这里向老中炫耀你的英语吗？
这里的老中都挺遵纪守法的，我没看哪个老中象老外那么猛，一分钱不付的，有问题老
中都老老实实找律师，走法庭，改child support。大家都走的正经路子。无需您这个
外F思想的女人来教育，如果你要教育，就去教育老外，plz.
Personally, I believe you probably had some unhappy experience, or even was

楼主英语非常好，逻辑事实也很清楚，很有调理。有些人一开口就证明了自己的素质，
纯粹人身攻击和胡搅蛮缠，这种人会被淘汰，所以心态就更难摆正。

只有象你和楼主这样的傻逼才会被淘汰。
楼主这个傻逼，抱着自己的外F那种人的那点莫名其妙的优越感，来这里不断教育老实
守法的老中，面对广大不守法的老外，也不去教育一下，这不就是典型的外F贱人们干
的事情吗，贱人外F们有哪个能到老外的论坛上show 恩爱，show自己的混血小孩，根本
没人理她们，她们就来中国人的论坛上面，反复来炫耀，恶心的要死。
这child support的问题，根本就不需要任何智商就能解决，很简单，找律师，走法庭
，这么简单的事情，哪个老中不会干？你这种心理恶毒智商为0的人认为守法的老中，
能适应这个社会的
老中会被淘汰。反而象你们这种贱脑子，认不清现实一味“老外就是浪漫”“外国就是
保护妇女儿童”，“女人可以让前夫赡养一辈子”，不会被淘汰，这是什么逻辑，有逻
辑吗？

lz英语都是一些常用词汇，成语俚语一句都不会用，到了老外论坛上面两句就被别人说
晕了
最著名笑话不就是某外F在ooxx中间，老外说了一句nut，外F急急忙忙从床上下来给老
工拿花生米
lz那些略微深刻点词语就不会了，否则就不会在帖子里面夹杂那么多中文词汇
