受到2205-b letter, 要求提供一系列资料，其中copy of passport and US visa 是用
醒目的黑体字标明的。看了一下tax return, 感觉和tax treaty有关。我是在canada学
校毕业，然后来美国的，签证在canada签的。用过tax treaty好几年，到2009年初，被
学校告知我不符合tax treaty。其实我真的不知道，觉得和其他中国学生没区别。学校
告诉，发过的 w2和1042s不会在更改，但从现在不会再发1042s. 所以我2008的保税还

如果要你补，你就按他们的要求补，这种信一般连利息都给你算好了，你把证据和
支票寄给irs，按他们的说明做。如果你认为有的是不该补的，给他们证据和说明，
然后按你的算法给他们寄支票，如果他们认可了，或者不认可，都会按他们的算法
确认你该交的钱，多退少补。

You need to be very carful. Audit is not a big deal. However, when negative
audit result comes, it matters. Pay penalties and interests is not a big
deal. However, red flag to the IRS and state tax authority matters. You
would not want to be on the IRS watching list every year. Prepare it well
and do not lost your credit/public record in this country if you still want
a good life here. Good luck to you.

thx, then how should I prepare it? every year, university sent me a letter
to do tax treaty application (I only need to fill my name and visa
information in the application). It was always approved until 2009. so, can
I simply say it is not my fault, but I am willing to change any error in my
tax return if any.

thx, but I am not asking if I can get treaty benefit or not, instead I am
asking how to fix the problem.
since it was troublesome to fix any error for previously issued w2 and 1042s
, neither my usiversity or I have taken any actions. simple says " let it be
for the past". I knew that I should have read the term more carefully, but
apparently my university also has some responsibility for the approval of my
application. can I just explain to irs that the mistake was caused by a
misunderstanding of the treaty?

我不明白LZ为什么认为学校在这件事情上有责任？学校出W-2 or 1042S都只是出具LZ的
收入和所扣各种税的证明，具体的怎么报税，是LZ的责任，LZ用错了tax treaty和学校
有什么关系。
如果LZ认为学校错按China-US tax treaty扣错了税，年终报税的时候IRS会多退少补的
，扣少了LZ应该主动补交，学校是没有责任的。

I do not think you fully understood me。I am asking help on HOW TO EXPLAIN
TO IRS for the mistake, not asking you to teach me I have been wrong. I
appreciate your writing, but it does not seem to help on the issue.
The mistake is: I simply thought I was eligible for treaty because
university sent me 1042s. They asked me to show passport and US visa every
year in order to verify the eligibility. They would not send me 1042s if I
was verified to be not eligible, I guess.

Just provide whatever documents IRS asked for
and let IRS figure out.
You would get a notice from IRS saying how much tax and interest you owe.
then pay it off and relax for the rest of your life.

我想我已经说的很清楚了。W-2 & 1042s都只是收入和缴税的一个记录，并不是享受tax
treaty的证据。LZ现在要做的是解释一下因为自己不懂，所以用错tax treaty，并不
是有意逃税，然后按照IRS的要求提供所有文件，并补缴税款即可。如果IRS算的和你自
己算的税不一样，你也可以和他们argue，这些都没有问题的，老美也经常弄错，也经

treaty的证据。LZ现在要做的是解释一下因为自己不懂，所以用错tax treaty，并不
是有意逃税，然后按照IRS的要求提供所有文件，并补缴税款即可。如果IRS算的和你自
