1. No. They cannot ask for training fee, unless you have signed any contract, which in the US is typically illegal in itself. 2. No. Your case does not constitute h1b fraud. I would advise you to get in touch with your new employer's immigration attorney to get an opinion. 3. It is considered unprofessional to walk away from a project. You should always avoid walking away from a project. Bottom line, you don't own them money. Some Indian guys have very odd business practices which they probably imported from India. This kind of practice can actually get themselves in trouble more than the people they threaten. My suggestion is: work with your new company to see if they have any flexibility in your starting date. Also, work with your ICC boss to make a smooth transition. Make sure you fulfill any obligation you have have made (2-week notice, etc). Tell them you will make your best effort to wrap up or transfer your work. But if he keeps giving you bullshit such as owing money, just tell him you will consult with your attorney.
