求助大家的意见.我是在OPT结束前递交的H1B申请,也就是过我的OPT合法被延期,直到我
收到H1B为止.后来收到USCIS的来信,说根据 Student Exchange Visitor Information
System(SEVIS)的显示,我去年的OPT并没有被通过.于是要求我:"submit evidence to
show that the beneficiary was maintaining a valid nonimmigrant status at the
time you filed this petition. A letter from the Designated School Official
(DSO) of your university will not suffice. It is the DSO's responsibility to
correct all the electronic system before the requested of status may be
granted. 也就是说我要找学校帮忙查证和修改DSO系统里我的资料.
但是在我的OPT上确实写着我是FULL TIME OPT,而且我也收到USCIS的EMPLOYMENT
AUTHORIZATION CARD并工作一年.何况我今年二月才拿着我的OPT回国了一趟.真得不知
道这系统是怎么了.如果我的OPT有问题,怎么可能还拿它往返美国和中国呢?
后来学校尝试去修正系统,结果出现问题.学校的回复如下:
The school tired to manually update your Cap Gap information in SEVIS.
However, the Department of States (DOS) has taken off the option to update
your employer's information at this time. Furthermore, DOS has not recorded
your automatic OPT extension (Cap Gap) which we normally can see on a
student's SEVIS record. Your record does show that your H-1B application is
pending. We can try to request a datafix with DOS but it can often take
months to get it fixed.
我的律师回复的结果是:
I understand that you tried to update record in SEVIS, but it seems
something wrong with the system. According to the Request for Evidence
notice from USCIS (Please refer to the last paragraph on 3rd page), they
request your office to correct the electronic system. So I think we have no
choice but ask for a datafix. When you contact DOS, please point out the
urgency of this matter due to the response deadline ahead. I also attached
Ms. Lam’s H-1B receipt notice for your record.
我现在真得很着急拿到H1B因为我要带宽买房，贷不到款房子就没了!请大家出出主意,
看看有什么办法可以帮我尽早拿到资料. 真的很郁闷，不知道OPT怎么也会出问题！ 多
谢大家了！
