我h1b 10/31号6年期满，被公司律师害惨了，我2个硕士加上6年工作经验申请eb2都没
被劳工部首
通，现在时间这么有限，我想也不大可能找别的律师或者新工作了。如果期满要回国的
话，是不是必须
离境满一年？ 还是之前假期回国的日子也可以累计？
还有你们觉得我这情况找新律师有用吗？ 真被害惨了，去年8月办这个事情，公司律师
拖拖拉拉到1月告
诉我不行了。经验教训啊，你们还是自己去找有经验的中国律师，千万别信公司的律师
。他们拿薪水，
你办不成也不管他们的事。

不在美国的时间可以累积。
现在PERM批得不是很快么？可以再换律师申请一次，不过要搞清楚上次是因为什么搞砸
了。

But the case has been denied 4 times, the company lawyer even didn't tell me
about this for the first 2 times!
Yeah I am thinking about changing another lawyer, my department treats me
good and I can see they have tried everything for my case.....not sure if it
is ok I tell them this...

Can you give us some details? How can your case be declined? I know some
guys with some poor cases get PERM and I140 approved easily.

另找律师。 Tell your bosse/HR that is good for the company. 3 or 4 months
can get PERM done, then PP I140 before H-1 run out, you'll be able to renew
3-year. it takes skills to run PERM ad and recruiting process.
自己的事自己要盯紧。我有深刻教训。the company laywer did not tell me there
was a RFE on my first I-140, not response and denied. the consequence was I
missed the 2007 boat (then pay 10's of thoutands more tuition for my child).

like the above post said, I think you should have enough time to get PERM
and PP140. Firmly ask for changing of lawyer. these company-hired lawyers
are all garbage!

The job description that the company lawyer provided doesn't match my
position, this is the mistake the lawyer made.
Then they fixed and sent to Labor department again, but it was still denied.

Since the company has their own lawyer, it is difficult for them to agree to
hire an outside lawyer....
I was thinking about if I can find another lawyer, then I will talk to the
company after another lawyer agree to take my case and feel positive about
my case.
I emailed a chinese lawyer regarding my case, however, he said he can't give
any suggestions because my case is currently handled by the company lawyer,
he said we can talk more details if I want a fee-based service. I checked
the price, $200 for half hour phone call, it is expensive , also I am not
sure what conclusion we can make after half hour.....

我觉得你还是要先跟公司说好换律师吧。当然难，但你不挣取更没有。要说服你的老板
，大老板，大大老板们：浪费钱还是小事，但浪费了他们宝贵的时间是不能忍受的，所
以为了公司的利益你们不得不为你换律师
