From US immigraion point of view, the degree is based on how many years in the school. Simply it is like this: BS = 4 years MS = BS + 2 years, PhD and MD = BS + 4 years If you only have 4 or 5 years education in the school, it is very questionable if you claim that you are equal to U.S. MD, which requies 8 years college education.

This is a grey area. My personal experience with people working in the school of medicine is that people who have an interest in your background will look into your documentation of your training. Some people feel bothered (not to the extent of being cheated) about tranlating 4 or 5 medical school training in China to a 'MD', some feel fine and just care about your training. Is there some translation like '4-year medical degree'?
