The EB-3 category for persons born in China retrogressed to a cutoff date of
October 1, 2006 as a result of the demand for visa numbers exceeding the
available supply. Therefore, as of May 9, 2014, the Department of State (
DOS) will only send USCIS authorization on visa numbers for the EB-3
category for foreign nationals from China if the visa priority date is prior
to October 1, 2006.
Visa requests for the remaining applications that are not allocated visa
numbers will be placed in the DOS “pending” demand file. These cases will
be adjudicated to completion and assigned a visa number when the priority
dates are advanced beyond the applicant’s priority date.
