我的perm终于要上交了，然后律师告诉我说我的PD是The date the petition was
properly filed with USCIS。
然后我提出疑问，pd不是应该劳工部收到perm那天算起么。我还引用了USCIS官网的原
话：
Priority Dates for Employment Based Preference Cases
The priority date for an immigrant petition that is based on employment is
either:
· The date the petition was properly filed with USCIS, or
· The date the labor certification application was accepted for
processing by the Department of Labor (when a labor certification is
required)
因为以上两条是或者的关系，因此我问律师可不可能按照第二条来。律师的回复是：
The date the petition was properly filed with USCIS-please review what I
actually wrote earlier。
他所说的petition filed with uscis是不是I-140啊？而perm一般要半年才批，他再墨
迹墨迹我的I-140，那我的pd岂不是要再等一年？
请各位告诉我，perm被劳工部接收后，会自动给我pd，还是这个需要律师交个材料才给
？如果需要交材料才给pd，什么材料，什么时候可以交这个材料来得到pd？不胜感激。

我理解PD就是你的PERM 交上去的日期，但是要保留这个PD必须要140批了才行。

你的意思是：如果今天6／2／2014交了PERM, 半年后PERM被批，然后交I-140,然后半
年被批了以后，时间来到了6／2／2015，所以我的pd是2014年的6月2号么？这么理解
对么？

只有140之后批了
PD就PERM提交的时间。
你例子里面的6／2／2014

律师说的就是PERM FILE 的时间。这还没140什么事呢，你咋能理解到140呢，这理
解力太强大了。

人家理解的没什么问题
律师说petiton filed with USCIS
明显说的是140
PERM一不叫petition,二不是向USCIS递交

楼主的理解正确。不过现在没有必要跟律师argue。先file 上去再说。
而且又不是律师定PD，最终还是USCIS定的，人家知道哪个是你的PD。你自己也知道就
行了，现在不要担心过多。

原来如此，看来我的律师要么doesn't know what he's doing，要么就故意不和我解释。

我倒是希望我理解错了。saitama给出的解释我更喜欢。完全不是不相信ta，（问大家
）只是谁还能证实saitama的观点是对的？

saitama的观点是正确的。140批了，PERM收到的日期就是你的PD，140批之前，所谓PD
都是假的。

楼上们说的都很含糊。条文的意思是分non perm eg eb1 or perm based eg eb23
If former then 140 date is pd, else if latter then perm date is ur PD.

Priority date is the date ETA 9089 filed electronically with Department of
Labor,
也就是说在PERM时，律师帮你向劳工部申请劳工纸那一天就是你的PD。
A priority date is the date when an alien initially expresses his or her
intent to immigrate to the United States through an appropriate petition.
For most employment-based immigration petitions, this is the date that a
PERM labor certification application (ETA form 9089) was received by the
Department of Labor.
For employment-based petitions that do not require labor certification a
priority date is the date which an immigrant preference petition was filed (
USCIS forms I-140, I-526, and I-360).
