this is what I wrote to the senator in our state, who is one of Gang of Eight member. Dear Senator xxx My wife and I are waiting for my green card application under EB3 China category and my priority date is March 2012. We have been observing recently that no one ( or very few people ) in EB3 China category has been approved for green card since May 2014. This is because the cut off date for EB3 China has been held in 2009, while there is no demand for cut off date before 2011 in that category. There is no statue that mandates how the visa quota in this category should be allocated explicitly, however the allocation scheme currently used by Mr. Charles Oppenheim in Visa Control and Reporting Division in the U.S. Department of State is clearly a violation of diversity principal and needs to be put under proper investigation. Without any external investigation and interference, no green card application under EB3 China will be approved within next few months and this has caused tremendous problem for thousands of people that are waiting for their green card for their family reunion and career advancement. I believe our great nation is built on a equal basis among all people and it is the justice in our public service sector that made our nation a success in the history of man kind. I believe dear Mr. Senator, you are an active player in immigration reform and this will be the engine for our future. Thank you Best Regards

I am writing to seek help on our Permanent Residency (I-485) application at the US Citizenship and Immigration Services (USCIS). Our I- 485 with a priority date of XXXX are currently under the category of “A Professional w/ Bachelor’s degree” (EB-3), which has a cutoff date of 01APR09. Senator XXX, we are asking you for the following help: 1. Inquiry Mr. Charles Oppenheim, who is the chairman of the Visa Control and Reporting Division of the U.S. Department of State, why the cutoff date for the class of EB-3 China has not been advanced sufficiently to stimulate the appropriate demand of green card applications. 2. Request visa approval data and inventory data under all categories to be published. Below is our case information: XXXX Here are the reasons that I believe the cutoff date of EB-3 China should be more advanced and perhaps get into year 2011. As you can see from the following Figure, in Jun 2014 the cutoff date for EB-3 China has been retrogressed back six years in one month. It would be reasonable if the visa is oversubscribled significantly. However, since May, 2014, my observation is that no case or (few cases) under EB-3 China has been approved for green card. The lack of approved EB-3 cases in the recent six months indicates that perhaps not many people in the EB-3 category has the priority dates before the cutoff dates so that their cases could be reviewed by an immigration visa officer. This further means that the cutoff date for EB-3 is likely too conservative. If the cutoff dates do not advance significantly and rapidly in the coming several months, it is very likely that in the coming year, the annual quota of visa available for this category will not be used up but go wasted while on the other hand, thousands of highly capable, intelligent, and hard- working Chinese beneficiaries are waiting for their green card cases to be approved. This problem will clearly be an indication of immigration inefficiency and unreasonable allocation of visa quota, and can potentially violate the diversity and equal opportunity principle that this nation has been built on. May-14 Jun-14 Jul-14 Aug-14 Sep-14 Oct-14 Cutoff 10/1/2012 10/1/2006 10/1/2006 11/1/2008 11/1/2008 4/1/2009 Therefore, I urge you, Dear Senator XXX, to help us urge Mr. Oppenheim to advance the cutoff dates for EB-3 China or publish the demand and supply data on a more frequent basis.
