Time line:
PD: Mar, 2010
EB3 140/485 RD：Apr 28th, 2014
EB3 140 AD: Jun 5th, 2014 (with wrong PD, since I changed company after I
filed first EB-2)
I didn't ask lawyer for a copy of I-140, therefore I didn't it was wrong.
Original PD became current in Dec 2014, but nothing happened.
After I came back from vacation, I filed a SR to USCIS on Jan 15th 2015
Two weeks later Jan 29th received response saying "pending and has been pre-
adjudicated. Final review by an officer is dependent upon approval of the
Form I-140 as well as visa availability based of your category and priority
date".
I thought it is normal according to other people's SR responses. But I
Contacted Lawyer to check with USCIS if my 140 is linked to my 485 correctly
. Lawyer found the PD problem.
The lawyer tried multiple ways: requested PD change for my I-140, contacted
Ombudsman Office to monitor progress, direct request to NSC to continue my
485.
Mar 3rd: received I-140 update notice.
Mar 4th: received I-140 approval notice.
Mar 5th 3pm: received msgs for 485 card in order.
Lesson Learned:
1. Need to ask for a I-140 copy to confirm PD if you changed a job.
2. When you received SR response like mine, don't think it is normal like
others. Follow up with your lawyer to clear potential issues.
Finally after more than ten years in US, after full 5 years waiting in line
for GC, finally we are GREENED!
