公司答应开始办绿卡,但是从律师问我们收集完材料已经4个月了,其中一直发信去问
律师进度,律师总是发一个文件给我们说这个就是进度,我们现在还在和公司处理第一
步:4后面我就不列了,请问一下大家这是正常的吗?为什么第一步要那么久,是公司
还是律师在拖我们?万分感谢
1. Finalizing Job Description and Minimum/Special Requirements for
position to be offered in Labor Certification with the Employer:
o This is the most important step of the process, and requires very
detailed discussion of the position offered by the sponsoring employer that
will be the basis of required recruitment in order for the employer to test
the U.S. labor market. We discuss actual, minimum requirements for the
position with the employer. We then review the employee’s education and
work experience to ensure that he/she also met the employer’s minimum
requirements at the time that he/she started employment, if the employee is
sponsored for the same job.
2. Prevailing Wage Determination:
o Based upon the job details provided, our office submits a request for
prevailing wage to DOL, who in turn issues a prevailing wage determination
and assigns a job category and wage level for the position. These
determinations take anywhere from three weeks to two months and processing
time is subject to change without notice. As of January 1, 2016 they have
been taking roughly 10 weeks to come back to us. We discuss this portion of
the Labor Certification process with the employer only.
3. Advertising/Recruitment:
o Once we receive an acceptable prevailing wage, we can begin all
required recruiting steps. The advertising consists of two Sunday ads in a
newspaper covering the place of employment and a wait period of thirty days
is required after the last ad has run. Other steps of recruitment are
discussed with the employer only, and include a state job bank listing for
30 days, posting of the job opportunity on the employer’s premises, and
various other required steps.
