lkjlj herein files Immigrant Petition in the third preference employment-
based immigrant visa category (EB-3) and concurrent Application to Adjust
Status for Alien Worker Mr. ljklkj
Attached form I-140 is a subsequent filing after a previous immigrant
petition in the second preference employment-based immigrant visa category (
EB-2) for the same beneficiary. The receipt number for the notice of
approval of the previous form I-140 is LIN-1kkkkkk and Alien Registration
Number assigned to the beneficiary is A kkkkk In accordance with USCIS
regulations 8 CFR §204.5(e), The current petition is based on the same
Labor Certification as the one on which the previous form I-140 is based.
The original certified Labor Certification is not attached since it was
submitted with the previous petition. In connection with this Petition, we
attach the following supporting evidence:
1) A copy of form 797 for the approval of the previous I-140.
2) A photocopy of the certified Labor Certification.
3) A copy of the beneficiary’s diploma for his degree of Bachelor from
China, which is equivalent to a U.S. Baccalaureate degree.
4) A copy of pages of Master Contract of the college showing the degree
requirement for the beneficiary’s position.
5) Financial officer’s statement showing the College’s ability to pay
the wage and the beneficiary’s form W-2 of year 2014 and 2015, and paystubs
for the months of August, September and October.
6) Money order of $580 as the filing fee.
Attached form I-484 is filed concurrently with attached form I-140 in
accordance with USCIS regulations 8 CFR §245.2(a)(2). According to USCIS
Visa Bulletin, Dates for Filing EB-3 Visa Application in October and
November of 2016 are before May 1, 2014 and Mr. kkkkks priority date is
February 2014 therefore is current now upon the approval of the concurrently
filed form I1-140. in connection with this Petition, we attach the
following supporting evidence:
1) A copy of form 797 for the beneficiary’s expired H-1B visa.
2) A copy of form 797 for the petition for renewal of the H-1B visa.
3) Photocopy of one page of beneficiary’s passport containing a
nonimmigrant visa.
4) A copy of beneficiary’s foreign firth certificate.
5) Employment letter.
6) Two identical color photographs of beneficiary.
7) Medical examination report with form I-169 sealed in signed envelope.
8) Filled and signed Form G-325A.
9) Money order of $985 as filing fee.
