我在ebay买了个iPhone5，item condition说明：
New: A brand-new, unused, unopened, undamaged item in its original packaging
(where packaging is applicable). Packaging should be the same as what is
found in a retail store, unless the item is handmade or was packaged by the
manufacturer in non-retail packaging, such as an unprinted box or plastic

下单后我叫他尽快给我发货。
他回复1：
I am sending the phone today. I removed the SIM card because it is tied to
my number.
我发问这不是全新的吗，说我希望你没开封。
他回复2：
i did open the box, only to remove the SIM card. Nothing other than that.
然后马上补充回复3：
let me explain fully, the new iphone SIM cards are activated in the box. so
if i were to send you my phone, you would have my SIM card and would turn
off my current phone. I took off the plastic and removed my SIM card from
the phone. The phone is brand new and unused.
这卖家是不是不厚道？他ebay上面没有说明开封取sim卡。另外带sim卡根本不影响他现
有的plan，不激活就行了。我现有4s的plan的另一个partner买了她的4s，直接原装未
开封带sim卡寄出的。现在这个卖家告诉我他开封取卡了，可信吗？
请问
1、如果我收到phone，其实不想退了，能不能开case让对方退两百刀回来？
2、如果我收到phone，要退，是不是可以要求卖家承担运费，并且先给我把全款打回来
？
