原公司申请的eb3, 140批了,有排期。现在已离职，h1b transfer到了新公司，发现原
排期到了，问了之前的律师，他说可以想办法帮我继续递交485，这样行得通吗？
大概是先递交485，然后处理要4个月左右，然后会有RFE, 12周内回复， 这样就有6-7
个月的时间，到时485 pending 180天，然后就可以把485 port over转到现在的新公司。
如果中间没成，180天之内有问题，最坏会怎样？
我之后还可以让我新公司重新开始办就好了。

这个想法不错，我以前也想到过，技术上确实有可能把 I-485 拖过 6 个月。
现在 I-485 处理只是理论上需要 4 个月，实际上很多人批准时间都比这个短。你可以
提交 I-485 时先不体检，出生证明不带翻译，等 RFE；交一个体检报告内容不全，再
等个 RFE；指纹通知来了以后先不去打，申请 reschedule，这些情况都可能使你的申
请处理轻松拖过 6 个月。
但是，你在提交 I-485 的当时，必须能够证明 eligibility，其中一项即为你申请
PERM 的雇主还能给你个 offer letter 或 EVL，你也愿意拿到绿卡后从事 PERM 上的
工作。如果你在 file I-485 当时已经没有可能回到原来那份工作，或者没有这种意向
的话，就属于典型的 fraud，这是移民局重点打击的一种情况。这个提交 I-485 时需
要的原 PERM 申请雇主 EVL 或 offer letter，即使 I-485 拖过 6 个月也不能免除。
不知道你的律师打算怎么弄。
再有，如果 I-485 真拖过 6 个月的话，排期有很大可能在这一期间倒退，只能拿着
EAD 继续等卡了。

如果你能拿到 USCIS 认可的 offer letter 的话，那就根本就不用等 6 个月了，卡可
能直接就批了（如果排期没倒退）。

Offer或者EVL， 而且职位相同，那不就确保了未来的职位了吗？
其实最想问下，这种操作最坏的情况会是怎样？
如果行不通，我H1b还是有效，我在用现在的公司重新申请绿卡 也可以的把。
至少路不会被堵死？

认你能够胜任这一工作，而且公司也能付得起薪水。
如果你工作换了，上述一切就都作废了，你的 I-485 也不能递了。
只不过后来有了一个特殊的规则，允许 I-485 pending 180 天以上的人换工作。

There is no fraud and no requirement that you be working there at the time

That way you may just use your current employment information. You may need
