是这样的，我和我家LG是上个月结婚的，然后我们开始弄绿卡的东西（婚姻绿卡）所有
的东西都准备好了，但是几天突然发现我们结婚certificate上写的是我的英文名，而
不是中文名字，一定是我忘记了，因为学校里考试啊什么的都是写的是我的英文名。
UGH，我问过这边移民办公室的人，那女的说只要ID上面写的是你的leagal name，应该
就没事。可是我还是有点担心啊，所有东西都准备好了。问下我还可以把写有英文名
字二不是中文拼音名字的结婚证的COPY寄过去么？谢谢

1. 140PP被拒因为没有Original Perm，这个不稀奇，本来就是靠运气。
2. 再寄485被拒
问题：你file 485的时候有没有同时把eb3 140的receipt附上？有没有把降级的依据和
说明附上？有没有把approved 140附上？有没有把PERM COPY附上？
如果你没有把完整的资料附上，mailroom的合同工的确是无法确定你的PD。
EB3的140 receipt上的PD是你的收件时间，比如我重新file的eb3 140的PD是12/13/
2013。
这是我律师的回复：
This is typical because the data-entry person inputting the information does
not know what the priority date is. The officer who makes the decision
will input the earlier date.
I-485：
合同工没有权利直接退件。（contractors cannot perform adjudications functions
）如果485有问题，必须经过第二次review。如果因为没有签字或者缴费不对，有可能
不经过USCIS的员工再审。
这是仅在没有签字或者缴费不对的情况下：a secondary review by an individual
other than the contract employee originating the rejection. This secondary
review may be performed by a supervisor, U.S. CIS employee, contractor
personnel, or any individual skilled in checking for fee and/or signature
deficiencies.
除上述两个原因之外的任何原因，合同工只能把他/她认为不对的情况列出来，由USCIS
员工第二次审仅列出来的问题，再决定退件还是不退件。
在mailroom发现的问题由USCIS来核实确认是否应该退件，才会接着review Medical
record，确定A#，进而data entry。进入data entry之后，如果之前有签字或者缴费不
对的问题，会process system rejects, 除此之外的问题经过USCIS核实之后，会
process manual rejects。就会收到退件了。

本来打算发140 pp，然后批好了再发485。结果pp被拒（因为没有perm），pp的钱退回
来了
后来只能分开发485
和USCIS电话，貌似理由是eb3的140里面是没有明确pd的，pd貌似和perm绑定？在eb3处
理好之前，USCIS mailroom的人无法确定我的pd究竟是哪天，所以他们只能按照：
1）eb2 140上的pd，没有current
2）eb3 140上的默认pd，就是file 140的哪天，还是没有current
USCIS给出的方案是通过某种流程获得一个关于我的pd的confirmation，然后一起file
485。还有一种方案是等eb3 140处理到某个阶段，pd确定之后，485应该才能通过
不知道有没有遇到过类似情况的，已经连续被拒两次，浪费了都一个月了

X1Yoga接4K的问题，老是不能4K，按驱动，好了一次。然后笔记本开机，再接显示器，
又是1080，貌似是软件问题，有人能解决么？三哥三姐写的程序太差了，就会踢皮球。
说着说着，居然就不回应了，然后接着要求开个新帖子，估计再没有人愿意解释一遍了
。印度的官僚在熬时间上，真的是世界一流...难怪造的航母一下就沉了，造的飞机还
不够掉下来的，依然不影响人家自信满满的要funding。
咱国家牛人给点建议，谢谢！

what do you mean your english name?
Did you go through legal process to change your name? Or this english name
is what you randomly picked up for yourself?
If it is later, i suggest you do nothing, waiting for rfe, then send back
with the document with your legal name.
Just for your future reference, all your important legal document should
have your legal name not the name you picked up for yourself

yeah. All the documents have my legal names on them except our marriage
certificate. The name on our marriage certificate is an english name (common
name)I picked for myself, my bad:(
what is rfe?? Could you explain it more specifically? Should I just send all
those documents first see what happends?

Mailroom的人照章办事而已，他们不是decision maker，如果略有怀疑，挑出来去给
USCIS的人去审核即可，要么他自己本身觉得没问题，要么就是USCIS审核过没问题。你
说的情况不是没有可能，如果越来越多的人拿到receipts,你的推论或者被饶进去的可
能性就趋于0了。
而且再说了，降级的根本在140上。

这是建议下载安装第一个链接的rar文件？谢谢，那我就试试。
然后就是第二个链接里的和第一个链接里的都是64位的？下载哪个更好啊？

Here is what my attorney advised on this issue:
This is the same situation we face with every I-485 where the I-140 is
pending. When we file the I485 we include info to show the priority date is
current. The mail room looks up the info to receipt the case.It is a risk
that the mail room will incorrectly reject the filing. We do try to mark up
the filing in various ways to get their head around what we are doing (which
is permissible)

To give an update, USCIS has incorrectly returned my I-485 because they do
not believe my priority date is current. My attorney says he is going to
explain things and re-send the filing soon. He is also going to ask that the
filing be reviewed by the mailroom supervisor, who will hopefully
understand the issue. My attorney mentioned that other lawyers have reported
this issue as well which, unfortunately occurs when a situation is somewhat
complicated like mine.

你这个case就是材料问题，我怀疑。不过再解释一次肯定没问题了。

Thanks, yoyo. Hopefully it will go through the second time. My lawyer did
include the information in the filing that my priority date is current and
marked up certain items to make it easier for the USCIS mailroom to see, but
unfortumately... I guess he will have to explain the situation more
thoroughly this time. Will keep my fingers crossed and provide an update
here when available.

真是faint, 反复和律师说要concurrent filing, 结果今天收到email:
we should receive the receipt notice within 2-3 weeks. Once we receive the
receipt notice, we can file the I-485s
希望不要错过末班车。
