版上的各位达人：
本人绿卡，配偶还是f1，年底毕业。最近看见fb-2a 的排期前进的非常快，9月份已经
到了1／01／2010，所以在想给她
file i-130. 不知道版上的各位达人是否有类似的经验？我也看了精华版里的相关帖子
，好像是公民的居多，绿卡的很少。
知道在排期以前她还必须保持合法的身份。我想如果排期进度还跟这几个月一样的话
，年底就应该快排到了，就可以办
ead和ap。当然，她同时可以在毕业前办opt，保持合法身份。只是不知道如果她有fb-
2a pending的话，对她申请opt或
h1 是否有影响？只是觉得如果能走fb-2a很快搞定的话，就会比她自己走eb要省很多麻
烦。不知道各位有什么高见。

你现在可以file130了。只file130不file485不影响OPT，也不影响H1

我为了file130特意咨询过律师，没问题的，OPT可以拿到。我跟LZ一个情况，F1，配偶
是绿卡，我已经file了
再说现在排期大幅跳跃，此时不file130更待何时，LZ赶紧行动吧。

是吗，那就好。十分感谢你的信息，非常有帮助。因为之前看一些帖子说fb-2a会有一
些negative的影响，所以还在犹豫。
如果是你律师说的那样，我就尽快给她file i-130。另外你file i-130 是diy 还是找
的律师？你递交了那些材料？我看了看i-
130表和instruction，因为我已经办过自己的绿卡觉得自己file i-130 还不是很难。
是不是i-130 file 以后，排期到了就可
以file 485，ead, 和ap，还是要i-130 批准后才行? 我知道eb类的是这样，fb 类的
就不知道了。对了好像看uscis的网上
说，要排期到了后，他们才开始处理 i-130，是不是这样？好像i-140是递了就处理不
用等到排期current. 看uscis的
processing time 基本上是要五个月。

官方解释上还是说会影响学生身份的，但实际上操作的话移民局不会为难你不给你OPT
的，这是律师说的话，应该可信
130自己搞搞就可以了
排期到了要等到收到通知再file485
排期到了具体多久能收到通知我就不知道了，你哪里看来的5个月？好像没那么久的。
应该是一个月左右。

我是在uscis的网站上查各个service center的processing time，除california的外
，其他center都是五个月，加州要一年。
能问一下你file了opt吗？

那个processing time是指收到收据到收到approval 收据的时间间隔吧，现在还是2009
年3月，这个月排期刚刚出来，所以还没那么快更新的，耐心等等看一下
我还没申请OPT，我还有2年毕业呢

PD has nothing to do with processing time technically but it is true that I-
130
categories with old PD got long processing time. Maybe this is just some
internal
decision made to correlate the two.
Also, Vermont center has longer processing time than California.
It seems most of the I-130 cases got sent to these two centers. Other two
centers
are just processing left-over cases.

你的意思是processing time是排期到了以后还要等的时间？还是PD到approve的时间？

什么叫both？不明白
网站上processing time是09年3月，如果PD是10年7月，那怎么叫both？如果是到了排
期再等processing time这点时间，就是排期到了还要等1年多。如果是从PD的时间开始
算，那就是只要10年7月再等1年多就行。两个时间相差很大，咋叫both？

Sure, I can understand 485 will be approved only if the processing time and
the visa bulletin passed the PD. Couples things need to be confirmed:
1. Is the processing time shown on the USCIS website started from the PD or
the date they receive the I-130 or started from the date when the visa
bulletin shows the visa is available for the PD?
2. Let's say if the I-130 is pending and the visa bulletin shows the visa is
available for the PD now, can you go ahead file I-485, together with EAD
and AP,

我说的是130的processing time，不是485的。
现在130的processing time是09年3月，而visa bulletin上130排期是10年1月。
我就是想知道PD是09月12月的人（他的130还未approve，因为processing time现在才到09年3月），但他已经可以file485了（因为PD已经当前），但是他的130什么时候会approve呢？

Your spouse's I-130 will be approved, it's just a matter of time. But please
note that I-130 has to be approved to be in consideration of quota. In
another words, only approved I-130 gives a priority date to be in subject of
visa quota; not pending I-130's.
H1 is an inevitable route to keep her legal until the quota becomes
available.

我的理解是当你递上130的时候， uscis马上会给你一个receipt notice，那个也叫I
-797C。如果你的PD已经current了，不管你的130是不是在pending，我想有这个I-
797C的receipt notice 就可以递485了。不知道我的理解对不对？
问题是uscis一定会在收到I-130后几天之内寄出一个I-797C receipt notice吗？还是
等到处理你的I-130表时才寄出I-797C？
我现在想递一个130，但我怕现在递上去以后， uscis不给我任何回音。那万一下个
月一旦变成current了，别人那时都可以同时递130和485了。而我由于没有uscis的任
何回音，到那时我怎么能递485呀？怎么能把我的485和130连上呀？不知道是不是值得
等几个个星期，看看下个月的visa bulletin怎么样？有什么好的建议吗？
