1月底 renew AP/EAD, 然2月份离境以 H1B，新的AP3月份批准，我4月份以H1B visa 入
美境，然后最近刚回国，带着新AP出境的这回7月份回美国，但是我的H1B visa过期拉
，我想这道我可以7月份用这个renew AP 入境马？我原来的AP4月过期。

如果AP批准之前离境，你renew的AP申请被视为无效，入关时会有麻烦。
你有H1B，你人在国内，约个签证，再入境是稳妥的做法。

就是说即使我用H1出境，也会导致我的AP renew 无效？

AP失效是与你离境有关，与你是什么身份无关。

is not under exclusion, deportation, or removal proceedings shall not be
deemed an abandonment of the application if he or she was previously granted
advance parole by the Service for such absences, and was inspected and
paroled upon returning to the United States. " - 8 CFR 245.2(a)(4)(ii)(B)
此处 previously 语焉不详，颇有争议。
上述两个难题，一直有纷争不已。现在有了答案，还是标案。
移民局在给 AILA （美国移民律师协会）的答复（见 4/2/08 Agenda）中如是说：
1) 如果 AP 在 pending 的时候离境，但是以 H-1, H-4, L-1, L-2, K-3, K-4, V-1,
V-2, or V-3 身份入境，其 AP 申请不认为是放弃；
2) 如果在 AP pending 期间离境，手中尚有未失效的 AP，且在该 AP 有效期内以 AP
入境，其 pending 的 AP 依然有效。
”

不知道有人用皮将这个解释使用过吗？就要回美国拉，有些紧张。
