DHS今天宣布将出新的规定让H4（H1B的配偶）能够工作，同时也对杰出研究员/教授的
绿卡申请做了变动。
dhs可能有权利直接通过这个规定，不需要修改已有的法律 - 相比之下，增加h1b名额
、绿卡改革，都是需要美国政府来修改法律，需要各路人马表决。

愿望是美好的，我粗看了一遍，有如下几个问题：
1：这只是个Proposal，刚开始征求公众意见，何时生效没提，最终稿的变动有多大未知
2：EB1这块看意思是要extend，但是细节没说
总之，我感觉只能算是一个鼓舞，未来还充满很多不确定性。

这个是EO, executive order，不需要投票，跟梦想法案一样，奥巴马大笔一签就好
过了60天comment period，就可以成为法律并执行

这可不是简单的H4能工作，要符合两条件之一。
个人觉得意义不大。
Under existing regulations, DHS does not extend employment authorization to
dependents (also known as H-4 nonimmigrants) of H-1B nonimmigrant workers.
The change proposed by DHS, would allow H-4 dependent spouses of certain H-
1B nonimmigrant workers to request employment authorization, as long as the
H-1B worker has already started the process of seeking lawful permanent
residence through employment.
Eligible individuals would include H-4 dependent spouses of principal H-1B
workers who:
Are the beneficiaries of an approved Form I-140, Immigrant Petition for
Alien Worker; or
Have been granted an extension of their authorized period of stay in the
United States under the American Competitiveness in the Twenty-first
Century Act of 2000 (AC21) as amended by the 21st Century Department of
Justice Appropriations Authorization Act. AC21 permits H-1B workers seeking
lawful permanent residence to work and remain in the United States beyond
the six-year limit.

加入这个法案通过了，就是EB1的条件会降低。
我是不是该申请EB1？（妈的，还有几篇papers没有发出去，赶在这几个月搞定然后eb1
）。

H1b配偶那个应该是利好，只要file了140，不管是EB1、2，配偶都不需要等485/EAD就
可以工作了。EB1A那个不大好说，如果是在不增加名额的前提下，降低标准。是不是意
味着EB1的EB2化，从而可能出现排期呢？

有可能。尤其是烙印多的情况下。不过我看了一看中国人的eb2名额，其实就比限额多
点。所以如果niw都跑去eb1了，那基本eb2也不会有排期了。

没想到这一条，只考虑了eb1的情况，140一批立马可以交485拿ead

所以其实eb1降低标准对中国生的广大研究生还是有很多利好的。多点同胞拿绿卡在这
里工作，多点跟印度人的竞争优势。

意图应该是可以使用其他EB类别允许使用的相关证据来证明达到EB-1的基本要求，估计
三条的底线仍然会在，否则就和其他EB区别不大了，但是对每条认可的门槛会放松吧。
看看comment period之后最后成文会如何，希望会是普大喜奔的好消息。

我十分不希望那条spouse 140通过后能够工作会通过，因为这个对于广大职场上的老中
是不幸的。
