1/8律师寄出的Fedex,有tracking显示USCIS收到.
2月初我发现不对劲,还没有RD,就问律师,律师查了下USCIS没有cash那个支票. 律师说
最近USCIS有些back up,让我再耐心等等. 上周我觉得不能再等了,律师今天也说这比较
strange, 要是下周一还没进展就再递一个package, void原来那个支票.
像这个事情除了等,我还有没有其他可以做的?比如打电话给USCIS查查.他们没取我的支
票,不知道能不能查到.
本来觉得case不强,没有打算PP,我10/21就OPT extension到期,是不是应该果断PP?老婆
是主申请人,一直担心PP会RFE或被拒. EB1B应该还好吧?
485就差律师寄回来我们签名再寄回去了,然后律师就file. 140已经批了的前提下,485
递交多少天后我大概能拿到EAD在手?

让律师写email或者打电话去问问看吧。
还有一种可能的情况是假如主要材料有缺失(比如140表缺页等), USCIS 可能直接退材
料而不给通知的。等你/律师收到退回来的材料就不知道什么时候了。我LD遇到这个情
况还好是PP很快发现了。

我刚问了律师,律师说我们没有receipt number,不能pp. 下面给我回了一堆. 现在是担
心给我丢了package,但那情况极少见,void了前面的支票律师又怕把情况弄糟糕.真是豆
腐掉进回里,吹不掉也不能打.
We cannot convert the case from regular processing to premium processing
without the receipt – or at least the receipt number.
If we can get the cashed check, then the receipt number should be on the
back and we can call USCIS and ask them to generate a new receipt. Of
course if they lost the package completely, they won’t cash the check.
Since we have confirmed they got the package via FedEx, there are just 3
possibilities, I believe:
1. They received the case and are slow to generate the receipt for some
reason.
2. They received the case and they generated a receipt and mailed it to
the wrong address and eventually it will be returned to them and they will
realize it and send out the receipt to the correct address.
3. They received the case and just completely lost it so no receipt is
coming or will ever come.
The last possibility seems increasingly likely what has occurred but I can
say from filing thousands of cases over 15 years that this #3 possibility is
very, very rare. It does happen but just very rarely. You see, the
government loves our money and they rarely fail to cash a check.
But given millions of filings, of course some small percentage of filings
are completely lost.
Possibilities (1) and (2) happen more often but require just waiting.
The solution for possibility #3 is to re-file the case but Mayo will likely
want us to cancel/void the check on the first filing which will be really
bad if in fact the situation is possibility (1) or (2). I am not opposed to
re-filing but because possibility #3 is so rare and canceling the check
will complicate the situation if it is actually (1) or (2) – I am reluctant
to do that until we have really ‘given up hope’.
I plan to reach out to Mayo this week to see if they can see whether the
check was cashed. If yes, then we will get a copy and look for the receipt
number on the back.
If no, that is, the filing fee check has not yet been cashed, then we will
ramp up on re-filing and assume possibility (3) – but again, it is quite
rare.

没有拿到receipt number 自然是不能追PP的。我的意思是因为我LD一开始就是PP 的,
所以快15天还没有收到receipt也没有被cash check时就知道不对了。好在律师去问了
才知道材料被退了。

我们都一个多月了还没cash check. 因为不明白状况,律师不敢void那个check. 那我也
让他去问问怎么回事. 律师好像还说过再没有任何反应的情况下不能去问USCIS"把我的
package弄哪去了".

以一直没有更新。后来也是等了很久觉得不正常，学校帮忙问了，才发现的。

前天老婆自己发信问了下USCIS，猪头律师非常恼火，说单位把case交给了他，不允许
我们自己联系，还说这件事到此为止，不想再谈关于这个case的事，不让我们再给他发
email，接下来他想咋地就咋地。
In the future, please do not communicate with USCIS on this filing unless
you discuss it with me in advance. ...... Please confirm by reply email
that you understand this.

我在2013年10月的时间，给老婆申请了I765和L2一起申请的，当时就没有注意有没有
CASH，一直到2014年1月L2批了，才发现I765一直没有被CASH，果断VOID CHECK，
重新递交I765的申请，运气比较好，2个多星期EAD就批了

律师迟迟不肯那么做,怕得罪移民局. 想再等等. 我们是 beneficiary,单位才是申请
人,他可以不理我们.

那你都过了三个月了. 估计下周没信息律师也得void,其实是单位开的支票.
