有经验的兄弟姐妹帮忙看看这个是表示background check 还没clear 么？ TSC 11/03

At this time, USCIS records confirm that this I-485 case for you and your
wife, is pending.
USCIS is committed to adjudicating immigration benefits in a timely and
efficient manner while also ensuring public safety, national security and
compliance with all relevant directives. While the processing steps for most
applications or petitions are completed quickly, a small percentage of
cases involve unresolved issues that may result in adjudication delay...
The agency is unable to determine at this time when the review process for
the I-485 application will be completed. USCIS will issue a decision on your
case once certain issues are solved.

我收到的回复和你的一样，就一模板回复，一句话background check 还没有过。我的
一年多了，
现在还什么进展也没有。

看到05年到07年的时候有很多方法催name check，为啥现在大家都不用呢？

真是完全连一点点信息量都没有的回复啊。。

你这个回复就是USCIS拖满30天后搪塞议员的标准回复。
议员告诉我，USCIS需要在30天内回复他的质询，然后我就在exactly 30天的时候，收
到了意思基本一样的回信。
反正议员也查不到FBI去，很简单就把议员打发了。

从USCIS的数据来看，（只看申请人是中国的，EB1类的）去年一月received 的 case
是220，到今年还剩122，也就是说有一半的人现在要等一年以上，难道真是这么高比
列的人background check都有问题吗？肯定不是，他们就是以各种借口拖着不批，所
以催也没用。

哎。。。USCIS 这帮光吃饭不干活的家伙。
是不是可以让议员帮忙问问FBI name check 过了没？

这个数据貌似我之前也看过，看过之后还有点不太相信。哎。还是对USCIS存有幻想
下面是我搜集到的前人催name check的方法，也不知道现在还有用么，我打算试试了
1. Contacted Congressman (received reply stating that FBI received requst on
Nov3, 04)
2. Requested FOIPA (received 'no-record on file' response)
3. Sent an e-mail to Secretary of State through their Website!! (response?)
4. Contacted Local FBI office and submitted a request (no reply so far)
5. Contacted local police (basically the deputy chief said they cannot do
much)
6. Contacted 2 senators. (I have stated in the letter that I am unable to
submit for Fedearal research grants that require permanent status. Based on
this, one senator contacted USCIS..still waiting for response)
6. Faxed request to Senate subcommittee on Immigration and homeland security
7. Faxed request to house subcommittee
8. Sent an e-mail to white house regarding the possible national security
risks of pending name checks..I have made no request regarding my namecheck
(got usual response!)
8. Started e-mailing FBI in May, 06. (Here I assumed some reasons for the
delay (like area of research.. and stated the same in my communication)

Name Check Processing Time
The majority of name checks submitted are electronically checked and
returned to the submitting agency as having "No Record" within 48-72 hours.
The processing time for FBI name checks usually take from 30-120 days but
timing does vary from case to case. The FBI's intention is to have all visa
requests processed within 120 days. Most name check requests that are over
60 days old are the result of the time required to retrieve and review field
office record information. Any case which is not processed within this time
frame is usually delayed because of a potential "hit" (match) which will be
further reviewed manually.
其实我们的情况，哪来这么多hit，等6个月以上的不是小部分人。我记得有个哥们快等
一年了，结果现在USCIS才把name check发出去。也就是说，7个月都没给他做name
check.这玩意就是个黑洞，没准相当一部分的人还在等着做check呢。

看FBI自己介绍Name Check：http://www.fbi.gov/stats-services/name-checks/name-checks-faqs
FBI号称每周7万Name Check，其中40%来自USCIS。算28000.第一轮check 48-72小时出
结果，（120天内重复的Case不会被再处理，直接打回去）第二轮人工查询，10天。两
轮都不过的FBI号称只有7%，算在USCIS，每周有接近2000人？！这2000人的check时间
就指不定了。。。。。
