现在人在中国，在办h1b，已经有b1/b2签证在12月过期。h1b下来的话最早也只能9.20
进入美国。由于有另外的签证所以我在想可不可能在9.20前凭旅游签证进美国，再转成
h1b，留在那里工作。问了领事馆的工作人员和一个律师，说法都不相同，想看看这里
有没有经历过这种情况的，知不知道是怎么样。非常感谢！

律師應該是按consular notice來幫你申請H1B吧, 這種情況你要到領事館申請新的H1B
visa stamp

额。。我现在没有h1b呢。是在等办下来。。不知道你说的新的是什么意思呢

if you enter US as B2 now, the status won't automatically change to H1 (even
you have H1 I-94 from current I-797) You will need to reenter again with
H1 visa stamp (or file I-129 again to get another good H1 I-94) to start H1
status.

去搜了下好像再file I129就相当于再申请一次h1b么。。。那看起来真是不行。。。
