大过年的收到原房东寄来打信，如下：

我们的情况是这样的：
只住了6个月。当时说好是month by month 1595/mo. 搬得很急，找好后两个星期就搬
进去了。原房东在我们搬进去前一天搬走的。当时就是看上了他month by month. 搬
进去时墙上就有stains and writings. One broken ceramic floor in bathroom,
missing blinds (don't remember how many) 我们是想买房子只是短期住住, 想凑合
凑合没有和房东理论。（实在是大错！！）另外炉头有两个打不着，厕所马桶盖快掉
了，gabage disposal didn't work,这三个都打电话给房东了，他让他的worker上门修
了，倒是很快。我们搬走前，我请了老墨来清洁的($100 大概1000SQF).
上面列的我承认是自己的责任的只有Kitchen granite stains and damage on the
wall (墙被门碰了个坑，孩子干的)，然后其他的我都不知他再说什么。想自己在住这
个房子前，前面的房子住了两年，一分钱也没有扣（当时留了$95 cleaning）.
现在房子可能租不住去想宰我们一把。我们也是没有经验. 请大家给我们只招。
我想给他写封正式的信，表示我只responsible for $250 and he has to return me
the deposit for $1595-$255, otherwise I will sue him. 如果大家有sample
letter to the landlord please forward to me.

样的意见和忠告恁把他弄成了精神分裂，到现在都还恍恍惚惚的。据说现在婚也离了，

先写信，没什么格式，就说损坏是搬之前有的，注明deposit送还日期，过期庭上见
，and will complain to BBB。。。
网上查＂landlord and tenant court your county＂，上庭没想象的可怕，麻烦。若
是民主党州， landlord／tenant law偏向tenant。
多收集证据（pictures， lease。。。）

给这里的同学更新一下。
上次发贴后，马上进行了信息搜索。在这里要感谢ID letusrun 和hdzhang888 的安慰
和信息（包子已送）。同时要感谢老邢，感谢google。
在那个夜深人静的晚上，经过一阵乱古歌，突然发现了一篇sample letter 提到了两点
supporting points 对我很有帮助。如下：
1。 Under California Civil Code section 1950.5, the landlord is required to
notify the tenant of his/her rights to a walk-through inspection prior to
moving out. ( It failed to do so).
2 The landlord is required to return the deposit in full within 21 days of
the day that the tenant vacate the unit or furnish him/her with an itemized
list of the damages caused by him/her along with copies of receipts for the
cost of repairing such damage or reasonable cleaning costs of the unit. (It
sent me itemized cost WITHOUT any receipt)
看到这两点我一阵欣喜呀。于是不再堵心，耐心地等到的搬出来的第22天。然后给it写
了一份信。（信附载供参考）
主题就是快点还回我$$$$ (十天之内)，不然咱们就法庭见，奶奶我也不是好惹的云云
。然后就是昨天(第九天)，收到寄来的支票，比我要的少了$150. 还jjww我打扫得不
干净，墙上有mark。妈的，墙上明明是上任留下的（我们是在上任搬出后第二天搬入的
），栽到我们头上。不过想想也是一点零头，我们当时也没有照照片，没有证据。算
了，不与it计较了。
我的这一例子告诉大家: (1)他妈的敌人都是纸老虎（2）他妈的不管是在中国还是美
国都是捡着软柿子涅（3）我们老百姓要好好学文化（法律），有知识走遍天下
妈的, 我的writing够烂了，从it的六行信里我愣是发现了3个语法错误。
好了。前几天在这里看到另一个人也和我一样被欺负，所以就写写我的经历，希望给
后来者提个醒。有用的话就发个包子鼓励一下吧 -- 码字真不容易呀。

Re: Security deposit return for tenancy at XXXXX
Dear Mr. Greedy,
I was your tenant at xxxxxx from xxxx to xxx.
As you know you are withholding $xxxx deposit for the townhouse above
mentioned and I am writing to you to request the return of my security
deposit, in the amount of $xxxx.
I vacated the townhouse on xxxxx. Before vacating, I hired a professional
housecleaner cleaned and left the townhouse in the same condition as it was
delivered to me, except some stain in the kitchen countertop, and a minor
damage on the wall behind the door in the main bedroom caused by the door (
which I agree to pay $xx in total).
The interior of house had old paint with stains and writings when I moved in
on xxx. Some blinds are missing and there were broken tiles in the bathroom
. Besides, two range burners were not working, the garbage disposal in the
kitchen sink was not working, the cover of the toilet in the bathroom
upstairs was moving a lot and was almost separated from the toilet. I have
called for the last three issues (range, kitchen sink and toilet cover) that
affect our daily life immediately and you had someone fixed them. （I want
to empasize in the letter that the place isn't in a good living condition --

When I received the letter from you describing the $xxxx deductions that you
charged, I was very surprised. You deductions are not acceptable. Please
understand that I am aware of my rights under California Civil Code section
1950.5, you were required to notify me of my rights to a walk-through
inspection prior to moving out. You failed to do so.
Moreover, you were required to return my deposit in full within 21 days of
the day that I vacate the unit or furnish me with an itemized list of the
damages caused by me along with copies of receipts for the cost of repairing
such damage or reasonable cleaning costs of the unit. To date, I have not
received a refund of our security deposit or any receipts which provides an
explanation for why any amount of this deposit is being withheld.
As a reminder, California Civil Code Section 1950.5(k)(1) provides for
penalties of up to twice the amount of the deposit if a landlord retains the
deposit in bad faith. We would appreciate a prompt handling of this matter,
so that I are able to avoid any legal proceedings to recover this money.
Please promptly send the funds to me at my new address: xxxxx within 10 day.
Otherwise I will take the matter to the small claims court, and write
review to BBB.
Thank you for your attention to this matter. I hope that we are able to
resolve this issue soon.
