Got H1 approved. However, I did not file change of status from F1 to H1
together with my H1 appplication package. Does anyone know when and how I
should file it...I put the H1B effective date as of 10/1/2011.

When my application for H1B was prepared, my attorney told me there was a
form for change of status (F1-H1) which could be filed together with the H1B
package (the related fee was around $400). I did not file that form because
I was not sure if my H1B could be approved.
I wonder if anyone can give me any info on whether I really need to file
that change of status form. I cannot put very much trust on my attorney(
sometimes she treated my case like filing green card with some extra
documents not applicable to H1B).

look at the bottom of your I-797 approval notice, is there a H1 I-94
starting 10-1-2011? If yes, your status will change to H1 automatically on
that day. If no I-94, you will not be in H1 unless you reenter USA with H1
visa stamp.

Thank you for your info. It seems I don’t have anything related to I-94 on
the bottom of my I-797 (only the mailing info of the Vermont center). Does
this mean that my H1B cannot be activated on 10/1/2011. Will my H1B be
cancelled if it is not activated on 10/1?
I wonder if I can still file change of status to activate my H1B in the US
instead of going back to China get a visa stamp.

没有I94的话需要出境激活。。

什么意思？申H1的时候还得同时申这个“change status from F1 to H1” 吗？
还得额外的出400刀？不然就得出境激活是吗？
那如果OPT延期的过程中申H1B的话，也得同时申这个change status吗？

记得原来曾发帖子抱怨过自己的律师，现在越发感叹职业律师的重要。一月份因为想赶
上去年的H1B名额，就在当地中文报纸头版找了个律师。没想到律师不但出了很多不该
出的错不说（比如非得让我的雇主打广告，说MONSTER一分不够)，还经常给我气受。她
告诉我CHANGE OF STATUS 等H1批下来后在补交也可以。
今天电话咨询了张哲瑞律师事务所，被告知即使现在递交CHANGE OF STATUS，也没人理
的，只能回国激活。还好H1B不会被取消。我的OPT明年5月到期，如果是今年8月到期，
真不知道该怎么办。现在打电话给律师，从来不接。强烈不推荐南佛罗里达中文报纸头
版的律师。。。
以前有同样经历的同学，想知道如果回国激活H1B都需要准备哪些材料呢。

H1B还需要回国激活的吗？“CHANGE OF STATUS”是要和H1B申请一起交吗？
我的H1B也是10/1开始，现在F1 OPT。不知道我的律师是怎么做我的H1的。

所以千万不要迷信律师
律师也不是万能的
不是专门做移民的律师很多时候可能还真没有版上各位搞得清楚
更甭提你随便报纸上抓个律师了。。
再说H1B其实并不麻烦
很多人都是DIY的
有空多来版上看看什么就都明白了
在美国身份是个大问题
H1B/GC啊这些自个儿的事情自己多上点儿心
指望别人帮忙也只是一时的
万一出了问题后果还得自己承担不是？

出境激活很容易
主要是护照+I797即可
其他辅助材料有备无患。。
BTW:是出境激活，不一定非要回国。。

H1B 批准了,只是以邮件形式的。7/21的时候知道的。但是还没有正式的任何文件。
我应该收到什么文件呢？EAD卡？谢谢

7/21批准到现在还没收到任何文件？
你确定你的律师也没收到？
你应该收到的是I797 Approval notice for your I129 Petition
如果申请时填的是Change of Status
I797A 底部会有新的I94

Thanks...
Is I-797 the Approval notice? Do you mean that the change stutus form is not
needed if we activate H1B visa outside of the US?

我的I797A下面有新的I94,但是有个疑惑是,是不是应该收到新的EAD卡呀?OPT的那张10
月份就expires了!

H1b没有EAD卡的。。就i94。。我们都是公司自己找的律师。。
